A 40-year-old Venezuelan national, Cubian-Perez, has been accused of assaulting a federal officer. He reportedly punched the officer during the arrest. The case is being prosecuted as part of Operation Take Back America. This nationwide initiative collects all the resources of the Justice Department to combat the invasion of undocumented immigration and protect the communities from the perpetrators of violent crime.

According to the press release published on the Attorney’s Office’s official website, U.S. Attorney Dominick S. Gerace II addressed the matter and asserted that attacks on law enforcement officers will not be tolerated. “As today’s indictment shows, those who threaten the safety of our federal law enforcement partners will be prosecuted,” he further added.

The charging records state that on May 8, law enforcement officials were carrying out a surveillance at a residence in Powell as part of an effort to arrest a suspected non-citizen suspect. Authorities said that the defendant later left the residence and got into a vehicle linked to the individual being targeted in the operation. It has further been reported that when a team officer from the arrest team turned on their emergency vehicle lights, Perez allegedly tried to escape.

Authorities state that the 40-year-old ran into an Enforcement and Removal Operations (ERO) officer and punched the officer in the face, resulting in the officer’s tooth breaking through his lower lip. He allegedly continued punching the officer when the officer and his team members attempted to arrest him.

Officers apprehended the defendant, who was charged by criminal complaint on May 8. A grand jury issued a single-count indictment against him on May 14. Assaulting a federal officer and causing bodily harm carries a maximum prison sentence of 20 years.

According to justice. gov, Assistant United States Attorney Nicole Pakiz is the prosecutor representing the United States in the matter. Unfortunately, this is not the first time a law enforcement official has been subjected to such a distressful situation because of an accused.

In other news, it was just a few days back that Orlando Justice, a 38-year-old man from Rochester, New York, was sentenced to serve 21 months in prison for intimidating a police officer. Similar to the above case, at the time of arrest, he reportedly threatened the officer about knowing his home and repeatedly contacted him via multiple cellular and FaceTime calls.

At the time of his arrest on Nov. 23, 2024, Justice was reportedly intoxicated and taken to a nearby medical facility, where he threatened the officer, warning that he would come to his place and injure him. According to authorities, during one of the FaceTime calls, he told the officer, “I told you that I would find you,” and intimidated the officer with a warning that he had “messed with the wrong one.”

Before this, an Oakland County man was sent to seven to 20 years in prison for threatening a judge for sentencing him to prison in November 2022 in a case linked to assault with a dangerous weapon.
