In a courtroom cam clip posted by Crimes & Courtrooms, viewers witness how a judge’s remained empathetic yet true dutiful after a young mother named Kincaid broke down in tears in front of him.

Kincaid faced a suspended 10-year prison sentence after admitting to multiple probation violations. During the court session, she pleaded with Judge John Stevens Jr. for another chance for the sake of her children. However, the hearing focused on her poor decisions—specifically, working an unapproved Lyft job and unsafely transporting her kids.

The state pushed for four years in prison, while her defense attorney requested that her probation simply be reinstated.

As the lady started crying, thinking about her children, the judge politely asked, “Why aren’t you thinking about them before you start making violations of probation or committing the offense of evading arrest or detention when they caught you out at 2:00 in the morning that you’re placed on probation for?”

The judge pointed out that the lady was caught driving a silver Mercedes with license plates that belonged to a white Tesla. When the police tried to pull her over, she fled and led officers on a dangerous chase through a bank parking lot and residential townhome streets before abandoning the vehicle and running away on foot. The woman then made a claim that left the Judge visibly baffled. According to her, she fled because a police officer started to stalk her.

“He was stalking me everywhere I go,” she told the judge. I went through I went to the store and he followed me at the store. I went to McDonald’s drive-thru. He circled around the drive-thru.I stopped at my family’s home. He circled that area five times, turned the bright lights on. I was scared. I didn’t know what he wanted or what was happening. I was really scared.”

The judge was informed bout a previous offense involving her children. She was put on probation after reportedly driving under the influence with her children in the backseat. The judge pointed out that if she had gotten into a car wreck, the children’ s lives would be in danger.

Kincaid apologized to the judge and promised to be mindful in the future.

“I truly, truly apologize for what has occurred. It was not intentionally. I’m not a bad person of continuous bad behavior, nor am I a racist society. I want to do the right thing and I want to be included with a 93% success rate of probation. I love my children dearly and I tried my best to not put them in harm’s way. I just made a mistake and I’m very sorry for it. And I don’t think that my kids need to suffer without me. Because they keep asking for me to be with them.”

However, the judge could see that her words don’t align with her actions. He pointed out that while she claims she needs to be free to take care of her children, her actions say the opposite. Getting caught committing crimes at 1:00 AM while her children are somewhere else proves she is not prioritizing them.

Upon reviewing the state’s amended motion to revoke the defendant’s probation, Judge Stevens Jr. ruled that allegations 2, 3, 4, 5, and 9 were true, meaning she officially violated multiple rules of her probation. She was ordered to serve a three-year sentence of confinement within the institutional division of the Texas Department of Criminal Justice.

Judge Stevens Jr. highlighted that she could have received the maximum ten years for this offense, meaning a three-year term represents a highly lenient outcome for her.

He announced that she will receive credit toward her 3-year sentence for the time she has already spent behind bars awaiting this hearing, which the judge noted is roughly 130 days.
