Washington police stopped a woman for DUI and began interrogating her. They soon realized she was erratic and had no control over her emotions. She admitted to m– possession; however, she denied being under the influence.
The officer told her, “Someone at Walmart said they saw you using dr*gs and they were concerned.” She replied, “I didn’t use dr*gs at all. I smell like ma– because I have CBD in my car, and I am a patient.”
She further told them she smoked occasionally. After that, the officer asked for her driver’s license and asked her to wait. The officers confirmed with the other officer and the witness. He explained that he saw smoke and smelled the odor of marijuana from the vehicle. At one point, she tapped on the officer’s bodycam, and he told her not to do that.
The police officer also noted she was emotionally unstable. She cried for one moment and returned to normal right after. The officer said, “Big mood swings. Big mood swings right now. Crying, laughing, singing, and dancing.”
She continued to sit in the car when the officer announced she was under arrest for DUI. The officer had to pull her out of the vehicle while she was yelling, “Why are you pulling me?” The woman was hurling abuses at the officers and rambling incoherently as the officers handcuffed her.
It was clear that she was under the influence, so the officers did not ask her to do field sobriety tests. They took her to the hospital for a compulsory blood draw and then to the station. Apart from marijuana, the officers also discovered open bottles of champagne in the car. While in the police vehicle, the woman was still yelling at him. The officer was reading her rights to her; however, she demanded a lawyer right away.
She maintained she did not do anything wrong when they were waiting for the blood draw. She also misbehaved with the nurse who was going to take her sample. She refused voluntary testing, so the officers had to get a warrant from the judge. Meanwhile, another officer went to Walmart to speak to the security guard who reported her behavior.
After the medical testing for alcohol and dr*gs she was taken into custody. The officers issued citations charging the suspect with driving under the influence and resisting arrest. Her court case is still pending.
