A teen, Jack Franchek, knew his rights well when police officers approached him after a neighbor made a complaint. The complaint was about the teen, Jack, riding on his motorbike and claiming that his father had a concealed gun tucked in his belt.
According to the bodycam footage and cop reports on the case, a dispute erupted over two teens riding gas-engine bicycles. One man reported arguing with the boys’ father, Michael Franchek, while the original caller claimed she saw Franchek carrying a gun as he walked away. A third witness didn’t see the altercation but verified seeing the teenagers riding through the complex.
Police officers barged into their home and arrested his dad, Michael Franchek. They did not have a warrant to come into the home and arrest him over the neighbor’s complaint without a solid reason. Franchek’s son started recording the officers as proof of their violation of the 4th amendment.
Then the officer asked him about the bike and its permit. He told him, “I was on my gas bicycle, okay.” The officer responded, That’s a gas-powered vehicle; you have to have a driver’s license.” The teen bravely replied, “Um, no, you don’t when it’s 50cc.”
Furthermore, he added that his father possessed a valid concealed carry permit and was legally allowed to carry the gun.
He also explained the arguments between him and his neighbor, who was irritated with him riding the bike. At that point, he was dominating the conversation, being aware of his rights and the police officer’s unnecessary arrest. They tried to corner Jack, but he refused to answer them.
He told the officers they were on his property and that his filming them was not the problem.
Michael Franchek was charged with interfering with an arresting officer, failure to disclose his identity, and disorderly conduct. But the charges were not dropped till May 20, 2024.
Michael Franchek later filed a federal lawsuit against Park City, alleging that his and his son’s civil rights were violated during the confrontation.
But the charges were dropped in 2024, given the circumstances and the evidence the teen recorded.
Officer Rodriguez was found guilty of misconduct through an internal affairs investigation. Sources confirm Officer Rodriguez was found in violation of five acts of procedural misconduct (specifically policy violations like recording, prisoner management, and report preparation) and was subsequently fired for failing to complete corrective measures.
Moreover, the sergeant was dismissed from the service.
