Despite being named Employee of the Month in August 2023, Charles Winters filed a wrongful termination suit against Magic Mountain LLC and Six Flags Entertainment Corp in 2025. There was another racial discrimination lawsuit as well, with the suit amounting to $20 million.
The lawsuit outlines severe racial disparities in workplace treatment. According to the claims, Black employees were assigned strenuous manual tasks, such as scrubbing floors on their knees, while white colleagues received easier duties, like managing cash registers.
Additionally, Black staff were told the 2024 company holiday party was canceled, only to discover it proceeded without them, and were subjected to strict uniform checks that other workers routinely bypassed.

It must also be noted that Black employees who were onboarded during Winters’ tenure were fired more rapidly, with turnover for non-Black workers in the same time period being much lower. The tipping point came when a White security guard stopped Winters without cause while he was leaving the park.
According to Winters, he was questioned without justification about his presence in the park, leading to the involvement of the Los Angeles Sheriff’s Department. The lawsuit details that despite being in uniform, he was asked for his ID, a measure he noted was never applied to non-Black employees, and his employee badge was subsequently confiscated.
Mafic Mountain has faced a lot of scrutiny for racially insensitive behavior, going back to 1988. The first case involved discrimination against Latino youths. 2001 saw lawsuits from both Black and Latino communities, when visitors belonging to those backgrounds were removed from the premises for seemingly no reason. This included a class action lawsuit from over 4000 Black patrons, according to the LA Times.

In 2004, Six Flags paid $5.6 million and distributed 7,000 day passes to settle a racial discrimination lawsuit filed by Winters. Although the company issued no public comment and strictly denied any wrongdoing, the park’s internal data revealed a sharp disparity: Black visitors accounted for just 7.5% of overall attendance, yet were eight times more likely to be ejected than non-Black visitors.
The lawsuit sought compensatory damages, punitive damages, coverage of lost wages, benefits, and even future earning potential. In the 2004 lawsuit, Six Flags said that they settled just to ‘get on with business’, and denied that any of the allegations were true.
