The Black Keys are suing Home Depot and Ym Brands Inc., the parent company of Pizza Hut, for using their songs without permission.
Patrick Carney and Daniel Auerbach are suing Home Depot for using the song “Lonely Boy,” and Pizza Hut for using the song “Gold on the Ceiling.”
Band spokeswoman Mary Moyer said in a statement:
“The experts confirmed that this was copyright infringement.”
The Wausau Daily reports that the Black Keys are seeking unspecified damages of more than $75,000 apiece. They also want Home Depot and Pizza Hut to stop using their songs.
Bloomberg reports that the song “Lonely Boy” was used by Home Depot in an ad for its Ryobi brand power tools. Pizza Hut allegedly used “Gold On The Ceiling” to promote its Cheesy Bites Pizza.
The Black Keys lawyer said that the use of those songs was “a brazen and improper effort to capitalize on plaintiffs’ hard-earned success.”
Stephn Holmes, a spokesman for Home Depot, said:
“We haven’t seen the complaint but we take intellectual property very seriously.”
The Wausau Daily reports that both songs come from the bands 7th album, “El Camino.”
