Kathryn Erbe’s stalker sentenced to 5 years probation

Charles Nagel, the man accused of stalking Law and Order actress Kathryn Erbe, has been sentenced to 5 years of probation nearly a year after the case was filed in June of last year.

The sentence was originally scheduled to be handed down on February 11 of this year, but it was postponed after a judge determined that Nagel would be required to undergo a psychiatric evaluation to determine his sanity.

During the court hearings, Nagel reportedly blasted Erbe before breaking down and pleading for mercy from the judge.

In the reports from last year, Nagel had demanded a hug from Erbe, as well as an autograph on the set, neither of which he received. He became flustered and started a campaign of terror or on Erbe and her family, going so far as to stalk them on Facebook and Myspace.

In an attempt to avoid prison time, Nagel called on his two daughters, Harley Quinn and Batgirl (and no, that is unfortunately not a joke), to plead for their father’s freedom. Ultimately, the judge found prison time to be unnecessary, instead sentencing the man to probation.

“The defendant is a troubled person with serious psychiatric problems requiring continuing treatment and supervision,” Judge Jack Weinstein said, adding that Nagel had already served 115 days in jail in addition to 380 days of house arrest. Nagel was facing up to 57 months in prison.

In addition to five years probation, Nagel was ordered to pay $42,000 to Erbe to cover costs and emotional damage.
