A convicted man, identified as Juan Carlos Agari Jr., entered the courtroom expecting Judge Boyd to give him a 5-year plea deal after March 3, 2021, when the defendant was originally placed on deferred adjudication. She crushed his hopes as she saw how his crime targeted a particular person. He had been imprisoned for assaulting his partner, but it wasn’t a one-time thing. It was a repeated offense on his part.
The judge confirmed, “By entering into a plea, you’re giving up those rights. Did you intend to give up those rights and enter into a plea today?” The man was charged with a third-degree felony with a prior conviction. By asking for a plea deal, the man was giving up his right to a jury trial in the case; however, he agreed to it.
His attorney explained in court, “I believe he did all but four classes of the [Batterer Intervention Program] BIP. But because of other circumstances, the MTR was filed against him.” Along with the Motion to Revoke (MTR), she explained he had family health issues that he was dealing with.
At that moment, Boyd intervened, “I mean, because he hasn’t learned anything. And I don’t know what’s happening in his relationship, but it doesn’t appear he’s learned anything. And I don’t know why I should sentence him to just 5 years when he’s been sentenced for assaulting a family member with a previous conviction.”
Instead of a five-year plea deal, he got a maximum sentence of 8 years. Apart from prison time, he would have no contact with the complainant and would not reside in a home with minors.
The judge realized there was a pattern of such behavior from the man. She called him out for being in court after the same complaints and allegations. She mentioned he was not allowed to keep ammunition with him as a convicted felon.
