Florida Man Who Claimed Girlfriend Choked On Penis During Oral Sex And Died Acquitted On Murder Charges


Richard Patterson claimed his girlfriend choked on his over-sized penis during oral sex and died accidentally. Patterson’s attorney pushed the Florida judge hearing the case to allow the jury to view the 65-year-0ld man’s penis as evidence. The request was never acted upon, but the Margate man was just acquitted of the second-degree murder charges levied against him.

Francisca Marquinez, 60 was found dead in her apartment at least 24 hours after her death. Richard Patterson said he did not immediately call 911 because he was embarrassed that his penis had blocked his girlfriend’s airway accidentally during oral sex and caused her to accidentally asphyxiate.

As previously reported by the Inquisitr, Florida prosecutors trying the murder case did not object to the showing of Richard Patterson’s penis to the jury but wanted the defendant’s sex organ to be shown erect. The prosecutors argued size mattered in this instance because the defense team had based its entire case on the claim Patterson was so well-endowed his penis could fully close his girlfriend’s airway and cause her to die from asphyxiation.

Francisca Marquinez’s decomposing corpse was found on the bed inside her Margate apartment on October 28, 2015, NBC 6 reports. When Richard Henry Patterson finally decided to make a phone call and report his girlfriend’s death, it was not 911 he dialed.

Only after contacting his daughter and ex-girlfriend, Patterson phoned his attorney, Kenneth Padowitz. The attorney was instructed to ask police officers to come to the apartment, the Daily Mail reports.

Florida police officers reportedly found a bag filled with both semen and blood-stained paper towels when they searched the apartment. More blood was also found on the hand of Francisca Marquinez and inside her apartment, Local10 News reports.

Richard Patterson and Francisca Marquinez had only been dating for about four months before she died. A neighbor told local reporters the couple had a stormy romance and had been heard arguing the night before she died. The neighbor also claimed Francisca wanted to end the relationship with her boyfriend.

Patterson was placed under arrest a week after his girlfriend’s boy was discovered. Text messages Richard reportedly sent to both his daughter and a friend said he had done “something bad and was so sorry.” The messages, which were presented as evidence in the case, reportedly went on to say that he had “choked” his girlfriend because the prescription medications he was taking were making him “crazy.”

The Florida man’s attorney was quick to point out that his client did not confess to strangling his girlfriend in either of the text messages. Former Broward County Medical Examiner Dr. Ronald Wright testified under oath that the victim could have died from asphyxiation induced by the oral sex act.

The cause of Francisca Marquinez’s death is still undetermined. Current medical examiner Louri Boiko performed the autopsy on the victim. The delay in conducting the examination caused by Patterson’s decision not to call 911 immediately allowed the body to decompose to such a degree it significantly hampered Boiko’s ability to determine an official cause of death.

Boiko said for Richard Patterson’s penis to have caused the death of his girlfriend it would have had to be lodged deep inside the victim’s throat for at least two or three minutes. If such a bizarre scenario had occurred, the Broward County official said the victim would have put up a struggle in an attempt to free herself while gasping for air. He did not find any evidence of struggle during his autopsy.

Omar Andrade, the son of Francisca Marquinez, deemed Richard Patterson to be nothing more than a “desperate man” attempting to avoid being convicted on second-degree murder charges.
