Lindsay Lohan Loses Grand Theft Auto V Lawsuit, Case Dismissed


It looks like Lindsay Lohan got “Wasted” in the lawsuit against developer Rockstar’s Grand Theft Auto V.

It’s no secret that a game full of satire like Grand Theft Auto V would come under fire from those who may or may not be accustomed to the antics that come with it. The game tells the story of protagonists Trevor, Michael, and Franklin. The three commit despicable and downright brutal acts throughout the length of Grand Theft Auto V. There’s plenty of dialogue and action that will bring attention to television and game series, and it wouldn’t be a proper Grand Theft Auto game without hilarity through homage.

Lindsay Lohan, the 30-year-old actress who is most famous for roles in movies such as The Parent Trap and Mean Girls, didn’t find such satire funny. In fact, she filed a lawsuit based on her belief that developers were using her image, likeness, and clothing. In a report by USA Today, it’s been confirmed that Lohan lost the case and that Rockstar was not at fault. Some are stating that Lindsay was simply looking for attention, and the claims seem to support the thought.

A New York state appeals court is responsible for dismissing the case. It took some time for the matter to be resolved, as Lindsay originally filed the lawsuit back in July of 2014. While her career had already been established, it was the stance from Rockstar that she was simply filing the lawsuit for frivolous reasons and publicity. One could argue that both sides have valid points in the matter, but Rockstar’s reputation has been heavily placed in the area of satire and exaggerated characters.

Take-Two Interactive Software Inc., the publisher who owns Rockstar games and 2K games, was ruled to have been innocent in the case of taking Lindsay Lohan’s voice, likeness, and portrait. The court’s resolution revolved around First Amendment protection.

“This video game’s unique story, characters, dialogue, and environment, combined with the player’s ability to choose how to proceed in the game, render it a work of fiction and satire,” the judges confirmed.

A report by The Verge notes that the character Lindsay Lohan is targeting is Lacey Jonas, a hollywood actress who appears in Grand Theft Auto V during a random event. Lacey is the face of Hollywood in the fictional city of Los Santos, the setting of the game’s many missions and story.

In the game, main character Franklin has dialogue that appears to target Lacey’s roles in movies. Among these roles, “cheerleader movies” and romantic comedies are what Lacey is known for. In return, Jonas retorts that Franklin is labeling her and that she has more character than that. While it could be argued that Lindsay Lohan is the source for such a character, the judges in the Manhattan Appellate Division believe and ruled otherwise. Satire is usually a touchy element in any work, but this will not have been the first time that Rockstar has dabbled in it.

Ultimately, Lindsay Lohan is taking a loss on the matter. Perhaps she’ll shift her focus, as there’s also the attention on her love life and the personal details that come with it. It was previously reported by the Inquisitr that Lindsay is rumored to be dating Dennis Papageorgiou, a restaurant and bar owner. There’s no telling whether or not Lohan is going to pursue any type of appeal to the case, but it would most likely fall upon deaf ears if the First Amendment protects Rockstar’s case.
