Hiawatha Robinson: Father Who Raped Daughter To Death Escapes Capital Murder Charge, Death Penalty: Justice?

Hiawatha Robinson was arrested three months to the day his 8-year-0ld daughter, Hiawayi, was reported missing. Following the arrest on Tuesday, Dec. 16, Robinson was charged with sodomy and murder.

According to WFLA, Robinson allegedly suffocated his daughter during the sexual assault. Needless to say, the findings have sparked outrage since he was reportedly a major supporter in the search for the child. Three months prior to the arrest, Robinson actually appeared on a news segment pleaded for his daughter's safe return. Mobile County District Attorney Ashley Rich released a statement in regards to Robinson's arrest and what he is accused of. She also revealed a number of shocking details about the case, which is still being investigated.

"He, being an adult, engaged in deviant sexual intercourse with a person less than 12-years-old. Deviant sexual intercourse is defined, in the law of the State of Alabama, as sexual gratification involving the sex organs of the mouth or anus of another person," Rich revealed. "The facts will show, that while engaging in sodomy in the first degree, Hiawatha Robinson Jr. caused the death of Hiawayi Robinson."

On the morning of Wednesday, Dec. 17, Robinson's bond was set at $500,000. Although many questioned why Robinson was even allowed a bond amount, Judge Bob Sherling explained that bonds must be set for "non-capital Murder cases." Judge Sherling also stated that the prosecution has not presented evidence that definitively supports a capital murder charge regardless of the alleged details announced by Rich. However, many local citizens are wondering why the district attorney's findings do not merit a capital murder charge. According to a recent poll conducted by, more than 93 percent of more than 1,400 poll participants agreed that the charges should be upgraded to capital murder.

Here are some of the reactions to Robinson's charges:

"In the poll I voted yes due to what I know at this point. I would think and hope there are reasons that the death penalty is not charged because the DA knows more than I. Regardless, this will be up to a grand jury that will see all the facts known. That said, I also suspect the defense will try to relocate the trial before all is done."

"There is no nice way to put this he is a sick dirty a-- piece of s---! And I hope he is castrated and raped everyday in prison! And when he dies I hope he burns in hell! Such a beautiful child! his own child! How could he doesn't that.!"

"May that little beautiful child REST IN FOREVER PEACE. May her worthless father get the death penalty. (he is another reason why all of the USA needs the death penalty with a "express checkout lane". I hope he is treated the same way and worse by the general population of prison. That poor lil girl how heart sickening & terrifying agony her last moments were at the hands of a monster that was her father a man who was suppose to be her protector. I wish I could skin him alive with a dull rusty spoon dipped in drano. May he rot in hellfire."

Robinson has been charged with first-degree sodomy and felony murder. He reportedly made his first federal court appearance today at 10:00 a.m.
