DUI Suspect Told Police He Was ‘Driving It Off’

A Florida man who allegedly had too much to drink decided to “drive it off” rather than sleep it off according to what he told police.

The suspect was pulled over for speeding in Stuart, Fla., shortly after midnight on US 1. The motorist was apparently traveling at about 57 mph (the posted speed limit was 40 mph). The officer making the traffic stop noticed that the man, 61, appeared glassy eyed, slurred his words, and smelled of alcohol. The motorist told the officer that he was coming from home where he had consumed a couple of drinks and was on his way to a bar to have a few more.

The cop then radioed another officer to come to the scene to conduct a DUI investigation.

In an arrest affidavit, the second officer wrote that the suspect explained that got behind the wheel after getting into argument with his spouse:

He also told me that his wife told him that he [had] been drinking too much so he decided to go out and ‘drive it off.’ “

The officer administered a series of field sobriety tests and based on those results he took the man, identified in multiple media accounts as Michael Moore (not the filmmaker who said Obamacare was awful), into custody.

In the Martin County jail, a breathalyzer test revealed that the suspect was over the legal limit. “Moore was given field sobriety exercises, and a breath test measured his blood alcohol content at 0.104 and 0.103 — greater than the 0.08 limit.” He was cited for speeding and DUI. He was later released on a $500 bond.

According to FindLaw.com, “People come up with some strange excuses for getting behind the wheel while drunk, but those excuses rarely hold up in court. If the judge doesn’t appreciate Moore’s ‘drive it off’ excuse and he’s convicted of a DUI, he could face fines and jail time… In light of his DUI arrest, Moore may want to consider just ‘walking it off’ next time he gets into a fight with his wife.”

Have you ever heard of anyone using the “drive it off” technique to sober up?
