Rand Paul Refuses Pat Down, Detained by TSA

Sen. Rand Paul (R-KY), son of presidential contender Ron Paul- both who are known for libertarian philosophies- was detained this morning in Tennessee after refusing a pat-down by the Transportation Security Administration, better known as the TSA.
Perhaps Paul was smuggling some illegal cupcakes? News of his detainment by the controversial agency broke via his dad on several social media outlets, and on Facebook, Paul told his many fans and followers:
My son Rand is currently being detained by the TSA at the Nashville Airport. I’ll share more details as the situation unfolds.
The situation, described as a “standoff” by many media outlets, was confirmed by Rand Paul staffer Moira Bagley, who tweeted:

@senrandpaul. He’s currently being detained by TSA in Nashville
Rand Paul himself has not yet addressed the incident on his own Twitter account, and his dad has not yet updated with any information as to how or if the situation has been resolved. The TSA, however, has released a statement about this morning’s events at the Tennessee airport, saying to the public:
“When an irregularity is found during the TSA screening process, it must be resolved prior to allowing a passenger to proceed to the secure area of the airport. Passengers who refuse to complete the screening process cannot be granted access to the secure area in order to ensure the safety of others traveling.”
Rand Paul has long taken issue with the invasiveness of TSA pat downs, and in a hearing last June, he said to TSA administrator John Pistole:
“I think you ought to get rid of the random pat-downs. The American public is unhappy with them, they’re unhappy with the invasiveness of them.”

If one has nothing to hide why sre they so insistant not to conform to safety measures? Have people in this country really forgotten 9/11? OR are they just soooo worried about being "political" that they are willing to take a chance and have a repeat of that gruesome day? Now days we do not always have to worry about only foreigners attacking us, we have a kot of dissidents right here in this country who are trying to HIDE behind the constitution.

Entirely invasive….if their equipment is not working properly an 8 month old infant can be stripped of its diaper. I am proud to have a senator representing my state that will stand up to government invasion of privacy. We should all be proud of this. It is not a statement of entitlement, it is a non-violent protest of the illegal and unconstitutional procedures. This is a government agency people. If it were airport paid for security that would have been involved in the situation, that takes matters into its own hands for providing "security" this would be acceptable if not encouraged subject and I am sure the senator would have complied if he chose an airport that had this in their rules for boarding but the United States Federal Government has no business to mandate and regulate these situations.

If there is an abnormality found, some steps just need to be taken to ensure safety for others. Elitists aren't exempt. If any have to submit to it, all do. Maybe Mr Paul just feels like it should be like so many laws they have passed….it's ok for us commoners, but not for them.

May I ask what duties he was performing that he could not take 30 or so minutes to ENSURE the public's safety? STOP hiding BEHIND the constitution. This country has gone down the road to hell since people startws taking their constitutional rights to the extreme! I am not agreeable to everything our government does, (most of the time I'm P.O.'d by the way rhey "work") but there are some rules (laws?) that should be enforced. The U.S. Constitution actually protects federal lawmakers from detention while they’re on the way to the Capital.

Ann Carson it is NEVER hiding behind the constitution. That document is the ONE THING that separates us from the rest of the world. It is what our soldiers die for. It is what our country was founded on. If you call standing up for the constitution "hiding" then you have no understanding of what has made our country stand head and shoulders above the rest of the world. The TSA is an unconstitutional department. William Wallace YOU should read it! Search and Seizure WITHOUT probable cause. But then with your knowledge (or lack thereof) you could not understand that in this case they HAD probable cause. Ann Carson: 9/11 was a dark day in our history. Not only did we lose lots of human life, we lost something just as precious. Our Constitution. With the government using the horrible events of 9/11 as a scare tactic, we have lost many of our constitutionally guarenteed rights in the name of security. The TSA has NOT FOILED EVEN ONE TERRORIST PLOT! There is NO evidence to support the continued degradation of our constitution. A few weeks ago, a man got on a plane with a sword cane. 2 weeks ago, a woman got on a plane with a gun. If a terrorist really wanted to smuggle something onto a plane, the TSA could not stop them. Roy Dean I apologize. I was under the impression that it was RAND PAUL that was detained. I'm not sure of his age, but if he is a minor it would be up to his father to refuse the search. I am aware of Senator Paul's position on the TSA and the article of search and seizure. However, in this instance they DID have PROBABLE CAUSE. To some people, I guess, The Constitution is similar to the Bible. You only read and understand what you want to read. I am not nearly as close to being a conformist as most of you. I do not conform to everything governmental. Most of you obviously conform to the idea that you can do and react to ANYTHING that you please because you can always USE the constitution to justify..

Patting someone down is NOT going to prevent terrorism, that said Ann – so if a government agency read your post and decided WITHOUT due process to enter your purse, house, pat you down as you walked down street or got into your car, which in the case of home grown terrorists would be a weapon of choice, you'd be okay with that?????

Ann Carson I understand that Rand Paul is a man of libertarian values and an ardent supporter of constitutionalism. I applaud the Senator for taking this stand against what he believes to be an unconstitutional violation of our 4th amendment rights. You may be part of the majority and take no issue with the schemes of the TSA in their conduct of homeland security, but you must recognize and honor the minority who do not accept this clear violation of the constitution. There has to be a better way, many have proposed increasing the presence of explosive ordinance sniffing dogs.

Ann Carson WOW-You are dumb. What was the "probable cause"??? You need "probable cause" to apply for a search warrant which is what the Constitution says you need…you NEED a WARRANT. In order to obtain a WARRANT you must articulate in an affidavit why a Warrant is being applied for… Probable cause is what POLICE need for an arrest not to search. He was also detained-not free to move about on his own..I guess you believe you are guilty before proven innocent.

There will always be people that take what they believe to the extreme. Should we allow those people that believe in Al Queda beliefs to board aircraft unchecked? May I point out that some of those people are American citizens? I am not saying that Senator Rand is one of those people, but what if? Do you really want to take that risk? Ann Carson I flew out of Heathrow airport in the UK just a few months after the Lockerbie Bombing. They had ample security screening positions BUT never once was I touched. They used scanners and if one broke down they sent you to another line. The TSA is a joke, if you will remember the 9/11 terrorists used the planes themselves as the BOMB. So in truth if you want to be really safe then we should do away with air travel all together. BUT common sense has escaped this nation as a whole. We take a risk every day we breathe air. To run around like chicken little screaming the sky is falling and putting in place something that has no chance of ever actually working just to make one feel better about life means that the terrorists have scored a point against the American public, by having our freedoms infringed upon. I know all too well about home grown terrorists/American citizens, DO NOT FORGET the Oklahoma City Bombing done with a rental truck and home made fertilizer bomb. My point is NO matter what check points one puts in place someone will figure away around it. The more we cower down to the thought of terrorism the terrorists win. I would gladly take the risk that the person sitting next to me on a plane might be a terrorist, because I have faith that there are people who do their jobs everyday to prevent such things from happening, but it is not the TSA.

I don't believe being careful is like chicken little. Why do you wear a seat belt in a car? Surely not for safety. 40 years ago we had no seat belts and people were killed in auto accidents. The mandatory use of seat belts was required by our government. Yes, we still have auto related deaths, but considering the increase in number of cars today, deaths have decreased. Don't you see that the government took away our right to decide how to live our lives? I mean really, if we choose to take the risk, who is our government to tell us any different? Do you honestly believe there should not be rules?

Roy Dean .. I have used the internet to gain knowledge. Could you please name a few companies, corporations, and/or professions that does not have a few "bad apples"? They exist in other places too. For instance, Congress, the House, All Departments, and even The White House! The media has only reported the bad and the ugly. Very rarely do they report the "good". So, could it be possible that the TSA is a necessary evil until a better way to insure our safety comes along?

Ann Carson no there should be rules, but using a seat belt as an example is a poor one. No one is standing at my car when I leave for work. PLUS it is my decision to put one on or not. The government did not take away my right to choose in this instance. They told me that I must wear one or face a fine for which a police officer, a person sworn to uphold the law, must catch me doing. The TSA infringes upon my right to privacy and my right against unwanted searches and seizures when they touch me or any other person when they deem it necessary WITHOUT probable cause. From reading other posts I know you don't get probable cause. Being patted down by the TSA is akin to the police department coming into your home, place of work, stopping you as you walk down the street, enter a building and patting you down touching you violating your rights, without a search warrant. There is a reason that they must go before a judge to show that they have probable cause in order to obtain said warrant. That being said if the TSA were required to operate in the same manner, I doubt anyone here would have a problem with their activities. As others have said before it is a slippery slope once we allow something as seemingly innocuous as the TSA to loophole our civil liberties. That is the argument that most people have been making. Do you not see it, we are not hiding behind the constitution nor do we want any terrorist activity to occur. We want a program that actually accomplishes something other than wasting our money blowing smoke up our butts to have the illusion that we are safe. To answer your question of faith – my faith lies with the men and women in our FBI/CIA/Homeland Security/Border Guards/ our Military branches and other agencies who have taken an oath and have been properly trained to look for, hunt down and detain those that seek to do America harm. Just not the $10 (or whatever they pay) an hour worker hired by the TSA or airport facilities. Oh one last thing. Putting something in place that does not work, but makes people feel better is a lot like chicken little running around saying the sky is falling. Similarity: Neither one does one iota of good for the public and both create a false sense of reality/security. How many terrorists has the TSA stopped? None How many times did the sky actually fall in the chicken little stories? None but the moral of the tale of Chicken Little is, depending on which ending you read : to have courage and the other is not to believe everything you hear or read. Either way in Chicken Little once the acorn fell on his head he ran to the king and they decided that everyone should wear a helmet. The TSA is our helmet, get it now?
