A 19-year-old woman in Virginia was charged with involuntary manslaughter after her bedroom activities with 26-year-old Shane Brooks led to his death due to a gunshot wound. The duo, who were in a friends-with-benefits relationship, were playing Russian roulette as part of their foreplay.
Ember McSpadden pulled the trigger on the partially loaded gun three times, and it ended up injuring Brooks in the neck. The gun had one live round in it, which Brooks gave to McSpadden. They were also engaging in foreplay involving knives. McSpadden told the investigators that they were checking the gun so that the live round was not positioned before hitting the trigger.
VBPD confirmed her arrest on charges of unintended discharge of a firearm. Police responded to an emergency call on March 5, 2026, around 1:09 a.m. after the accused reported the incident.

Brooks was pronounced dead at the scene. The authorities found seven guns in the room when he died; two of the revolvers were on the bed. One of them was used to shoot Brooks. According to the victim’s family, the two were not dating, and they were not aware of his situationship with McSpadden.
She got out of jail on bond and appeared at a preliminary hearing on Friday, August 14, 2026. Her attorney called it a tragic accident and noted, “his incident is a tragedy that my client deeply regrets, as evidenced by her emotional reaction during our hearing today. As the evidence presented in court demonstrated, this was a tragic accident that my client had no intention or foresight that would occur. “

There was ample evidence to suggest it was an involuntary manslaughter. Meanwhile, Brooks’ mother wants justice for him and a conviction at trial. McSpadden may get a maximum sentence of ten years if she’s convicted. She’ll next appear in court on October 21.
Brooks’ brother said, “There’s nothing we wouldn’t give to have him back. We wouldn’t even care about going through this, if we could have him back, even for a little bit longer.” The family is still grieving the loss, as they called Brooks the glue that kept them together.
According to Brooks’ emotional obituary, he served as a staff sergeant in the Virginia National Guard. He was a licensed pilot and used to run marathons. Members of his running community are organizing a marathon in his honor after the shooting incident.
