A 13-year-old New Mexico boy who “burped audibly” during gym class was handcuffed and taken to a juvenile detention center according to a lawsuit filed by his parents.
Facing charges are the boys gym teacher, principal and a school police officer .
The lawsuit also states that on a separate occasion the boy was made to strip down to his underwear in front of five adults at the school after being accused of selling drugs on the schools campus.
According to the family’s lawyer the teenage had been arrested along with more than 200 kids in the district for a nonviolent misdemeanor within the past three years.
That same lawyer is also representing the family of a 7-year-old autistic child who they say was handcuffed to a chair after becoming upset during a class.
Attorney Shannon Kennedy has also revealed that the school had another girl arrested last year because she didn’t want to sit next to a “stinky boy in class.”
Before the idea pops into your head that Attorney Kennedy is chasing down reasons to sue, there at least appeared to be some truth to the “stinky boy” case in which the school district quickly settled with that girls family.
In filing the suit Kennedy did not blame the police, who she says were doing their job, instead she says “It lands in the lap of the principal.”
If the accusations raised against the schools staff end in settlements or won lawsuits should the principal and teachers involved be terminated from their positions?
