New York Man Beats Wife’s Would-Be Rapist To Death With Tire Iron, Is Charged And Released Without Bail [Video]


A New York man, Mamadou Diallo, has been released from custody after he was caught on surveillance camera beating his wife’s would-be rapist to death with a tire iron. Diallo, a New York cab driver, got a call from his wife saying that a man was in their home an trying to rape her and another family member. She was able to fight off the attack with the help of her cousin, who was also in the apartment at the time, while her husband raced home. He’d been sitting in his car outside the apartment, getting ready to drive off to go to work.

When the New York man got inside, he raced up the stairs in an attempt to get to the couple’s apartment as quickly as possible. On his way up, he encountered Earl Nash, 43, in the sixth floor hallway. It was then that the New York man attacked the thug who’d allegedly tried to rape his wife, beating him with a tire iron inside of an elevator, reported CNN.

Earl Nash, 43, suffered a fractured skull and numerous other injuries as a result of being beaten on the head and body with Diallo’s tire iron. He didn’t survive.

New York police arrested Mamadou Diallo at the scene of the attempted rape and beating. Arresting officers recommended that the New York man be charged with manslaughter as a result of the savage beating, which you can see, in part, in this video.

Prosecutors disagreed with the police’s assessment of the crime, however, and according to a charging document that came from the Bronx District Attorney’s office, the New York man was actually charged with lessor crimes. On Tuesday, he was arraigned on criminal possession of a weapon, harassment, and two counts of assault.

Mamadou Diallo, 61, was ultimately released from the custody of New York police without posting bail, an almost unprecedented occurrence for a defendant who had been caught on tape viciously beating someone to death. When the New York man exited the Brox courthouse on Tuesday evening, he was greeted by the cheers of his supporters who are calling him a “hero.”

According to the New York man’s wife, Nenegale Diallo, 51, she had been home with her cousin when Nash had attempted to sexually assault her. She said that she got a knock on the door, and when she opened it, the would-be rapist pushed his way into her New York apartment, exposed his genitals and tried stripping her clothing from her body.

A law enforcement source said her cousin came to her aid, and it was then that she was able to break away from her attacker and desperately call her husband using her cell phone.

It was that frantic phone call that caused the New York cab driver to come racing up, weapon in hand, to defend his wife.

Now, a New York grand jury will meet to determine whether the evidence in the case is strong enough to indict the New York man. Patrice M. O’Shaughnessy of the Bronx DA’s office says that Diallo will be given the opportunity to testify before the grand jury in about a week.

Mrs. Diallo suffered bruises to her head when she was attacked, and was hospitalized due to her injuries. She has since been released. Police don’t believe that Nash knew her before he tried to force his way into her apartment and rape her, and they are investigating what led the now-deceased, alleged would-be rapist to target the Diallo’s apartment.

Police also told the media that this wasn’t Nash’s first run-in with New York law enforcement. His criminal record reportedly included almost 20 prior arrests, ranging from arson to robbery to assault.

The case drew people from New York, and all over the globe, to social media to share their opinions.

Mamadou Diallo has become something of a hero and a celebrity for beating his wife’s would-be rapist to death, with many saying that they would have done the same thing if placed in his shoes. Among his supporters are is his son, Abdul, who spoke out in his father’s defense.

“I think any husband would do the same thing as what he did. You see your wife being attacked and sexually harassed, you’re going to beat on the person. You are not just going to sit there and let the person leave or whatever. So I don’t think he’s wrong.”
