Driver Who Hit Three Teenagers Riding Bikes Files Lawsuit Against Victims’ Families For Emotional Trauma


On Oct. 28, 2012, Sharlene Simon hit three bicycling teenagers while reportedly driving 90mph in an 80mph zone. Richard Esch and Jake Roberts, both 16 at the time of the accident, suffered non-life threatening injuries. However, Brandon Majewski was killed on impact.

Needless to say, all parties involved were effected by the gut-wrenching accident that claimed Majewski’s life. But, you’ll never guess who’s filing a lawsuit for emotional trauma. Apparently, Simon and her husband, a York Regional Police officer, want to be compensated for the emotional trauma they’ve suffered as a result of the accident.

According to the Toronto Sun, speculation about Simon’s pursuit for a possible settlement began circulating back in April. Now, she’s reportedly suing the surviving victims’ families and the Majewski’s estate. The Canadian driver’s lawyer, Michael Ellis, recently addressed the speculation. He admitted Simon suffered no physical injuries from the accident but claims she’s suffered mental anguish and emotional trauma.

Canoe-CA reports that Simon is seeking $1.35 million for loss of work and psychological suffering (including depression, anxiety, irritability, and PTSD). “She would have lost everything,” Ellis said. “She would have been destitute, homeless.” She also insists that the teenage boys were to blame for the accident due to negligence.

“They did not apply their brakes properly… They were incompetent bicyclists.”

Simon and her husband had reportedly had an alcoholic beverage at a local bar prior to driving home in separate vehicles, but they were both under the legal alcohol limit. However, it was confirmed that Simon was speeding at the time of the accident.

Brian Cameron, lawyer for the Majewski family, recently shared his opinion of the controversial lawsuit. He admitted that he’s even shocked that she would file a lawsuit against the victim’s family.

“In my entire career, I’ve never heard of anyone ever suing a dead child that they killed… It’s horrible.”

Needless to say, many people are outraged by Simon’s actions. On an ostensibly genuine Facebook support page, “Stand by Sharlene Simon,” the admin posted a previous update about her possible pursuit for compensation from Majewski’s family.

“It appears the settlement negations are back on track. It has been determined that the bicyclist’s negligence is the proximate cause of Sharlene’s PTSD and therefore the cost of counseling will be covered by settlement proceeds… We are just waiting on an estimate from zest all providers and how much it will cost for a front end alignment of Sharlene’s vehicle.”

Of course, many Facebook and Twitter users had no reservations about telling her what they really think of her actions. Simon and her husband repeatedly insulted and dubbed “insane,” “disgusting,” “monsters,” and “morons.” The couple has even received death threats via social media.

“You people, the ones supporting this page, are a bunch of monsters. A poor boy was murdered and this woman walks because of her cop husband. Now they want to sue the poor family? Disgusting. How do you people sleep? How do you look yourselves in the mirror? You will all burn in h***.”

“Sick f****! You killed someone’s child! You should be in jail not suing them you ignorant cow! Have another drink and run someone else’s babies over!!!!!!! I can’t believe there is actually a page to support this c***!”
