Proposition 8 passes: gay marriage to be outlawed in California

Voters in California have passed Proposition 8 by a narrow margin.
The proposition defines marriage as between a man and a woman and bans GLBT marriages, and invalidates existing marriages.
At 1:45am PST with 78% of precincts reporting, the yes vote had 52% of the vote, with a margin of over 300,000 votes. The vote has trended lower for yes throughout the evening as larger centers have been added to the tally, but the trend would appear not strong enough to change the result.
Opposition to Proposition 8 was strong in the tech community, with many leading companies financially backing the no campaign.

How did you determine that the initiative-passed law “invalidates existing marriages?”
According to every other news source, it is not determined whether or not the amendment invalidates existing gay marriages.
That issue is expected to go into the California courts, and we already know what their track record is with respect to gay marriage.

Proposition 8 according to the State of California “Provides that only marriage between a man and a woman is valid or recognized in California.”

That is also supported by other sites, including news sites. Whether the courts change this is obviously up to them, but as it stands my interpretation is correct based on the public record.

Having watched closely from the other coast, My heart goes out to all of you in California, no matter your orientation. The Presidential campaign was a victory, but today it remains just a little bit darker knowing discrimination is not only allowed on your ballot, but allowed to pass.

Gay Marriage should definately be allowed. NO on Prop. 8! Dont discriminate! YOU name a religion and they are all against EACH OTHER, believing all kinds of heinous things about each other — hating gays is ironically one of the few things that unites them in bigotry and hypocrisy. You should be able to believe in whatever supernatural figures you like, including Zeus if you so choose, but to impose this belief onto others is not only unfair, it's unconstitutional. It's ironic that President Elect Obama mentioned gays in his victory speech last night just as gay rights were being stripped away across the country. I think his mentioning of gays portends to a slew of prop-gay legislation in the future. Gay marriage WILL come (back) to California and the VERY NARROW passing of Prop 8 will simply mean you are going to be hearing a WHOLE LOT MORE noise from gay people than if you'd simply granted them equality this time round.

HETEROSEXUAL DICTATORSHIP imposes to eliminate gay people's rights in 4 states. Haterosexuals in Florida, Arizona and California ripped away gay people's right to marry instead dictating all marriages mush be haterosexual. In Arkansas hateros eliminated gay people's right to be foster parents (even after every poll said it would be a landslide in the other direction).
What other rights will gay people lose in the next election because of the heterosexual dictatorship?

Since when is it ok for the majority opinion to take away minority rights? At one point in time interacial marriage was illegal, that was overturned by a supreme court case, Loving v. Virginia, if it had been put on the ballot it is likely that in that particular political and social climate interracial marriage would have been banned, just as gay marriage has been banned today in California. Would that have made it right!? If the state or country had voted and said, no, black people and white people can't marry, do you think that majority opinion would have been right? It is not up to the majority to determine another's basic rights. The supreme court needs to be able to make decisions on behalf of the minority, protecting their rights, if that ability is taken away from the courts then how else will the minority voice be heard, and how will their rights be able to be protected. Everyone is entitled to the right to Life, Liberty, and the Pursuit of Happiness, this new ammendment is eliminating the pursuit of happiness for a portion of the people of the state of california, yes they may be the minority, but that does not mean that they deserve to have their rights taken away from them by a self righteous majority.
The main objection that people have to gay marriage is that it would take away from the “sanctity of marriage” If that is the case, then people objecting to gay marriage do not have a legal leg to stand on. They are basing their opinions on their religious beliefs of marriage, and not on any legal reasoning. They are afriaid that allowing gay marriage will interfere with the church by forcing them to grant marriages, but that is not the case. The government can't force a religious institution to perform a religious ceremony, that can't and will not happen. What is happening is that because people are making their decisions because of the religious and sacramental connotations of the word marriage, people who do not share those beliefs and do not asign those beliefs to the ceremony of marriage are having those beliefs forced on them. It is those individuals who's religious freedoms have been imposed upon. The legal definition of marriage is being narrowly interpreted based on the religious beliefs of the majority, and not on anything that can be interpreted as legal reasoning, which blatently interferes with the rights of the minority.

Please!!!! Doing the RIGHT thing has nothing to do with discrimation….Marriage is between A man and A Woman, this is all what the supporters believe and their rights to express it, this was approved back in June through Voting!! Then was overturned by the judges, our right was stripped and discriminated back then, now it proves again what the majority wants and live with it!!!

California might as well be the new South! Unfortunately, this large state is not as educated (oops, it is only state educated)…than the Northeast! Perhaps, many have not been fortunate to have a liberal arts education. If they did – I think they would be better critical thinkers! By ruling yes on 8 – this IS discrimination!

Lol I'm glad you're not the only person that saw that this article was definitely poor reporting. As for California, I've really lost respect in my own state, the state of understanding everybody as equal to one another. Liberty and Justice for (ALL) was definitely not shown when Prop 8 was created. And as somebody else said above, you'll just hear more from the Gay community until they're allowed to have equal rights as everybody else.
If you think about it, this is a very minor repeat of history known as the Civil Rights movement.. and a dawning of a new (and wonderful, full of understanding) age. I support Gay Marriage and always will and to all that had been married in the state of California, I mourn your loss. Nobody should have to be told they can't marry the person they love. And c'mon “Civil Union” Just sounds so void of feeling.

It wasn't about gay marriage. I have no problem with it personally, but I voted yes because I don't believe the state supreme court should have the ability to overturn something we the people have voted on.
On the gay marriage issue, I'd like to point out that now the state has voted twice against gay marraige.

When did morality become a civil right? I do not hate gay people, but feel it is obsurd that around 5 to 8 percent of the population can dictate what happens in the entire U.S. . There is not a television show that that can escape some mention of homosexual activity, kissing, ect. There is not a National amendment giving gays the right to marry. Without such an amendment the individual states have to decide for themselves. It was voted on fairly get over it. Just because famous actors and actresses want to force such a cause to pass does not mean the rest of the people in the state have to bow down to immorality.

In a day that we celebrate in the victory of President Elect Obama, I can't help but feel the “backward” opinion of those who support proposition 8. I HOPE that those who use the term TRADITIONAL understand that word in itself can mean many different things. Minorities of all backgrounds, people of faith and women who support this prop should be ashamed for supporting a cause that is taking away a right that all of us should have. For those that use their faith as justification I am appalled that your “church” would raise millions of dollars to create inequality while public programs close, schools suffer and people with no food continue to go hungry. Yes CELEBRATE.. BE PROUD… I hope that one day your freedom is never challenged and that someone else's “traditional” views supersede yours. I'm sorry but MY TRADITIONAL views do not include priests molesting young boys NOR do my TRADITIONAL views include having multiple wives and living in compounds. For those that said YES to Prop 8, I hope the guilt burn on your shoulders. Your church is not my church so I do not apologize in saying that your morals are a hypocrisy. So sad when religious fundamentals trump common sense and leads to the persecution of fellow people. Although I'm not gay, my heart goes out to everyone this vote affects directly. I can't imagine feeling completely unaccepted in my own country and inferior in terms of rights in a nation that supposedly values human rights above all others. In the long run, we all know that those voting in favor of prop 8 will end up on the wrong side of this issue. It's been proven time and time again through history and will be proven again in time. Just too bad that you have to suffer further persecution before seeing that light.

We voted and it should stand, it should have stayed last time with prop 22. Why keep on challenging it in court? Organizations that were against Proposition 8 officially –> all the highly circulated California newspapers, well known civil rights organizations, well known teacher organizations, well known law organizations and also SEVERAL religious organizations.
Almost all the organizations that supported Proposition 8 officially –> conservative Christian organizations. Don't believe me? Look it up.

I voted no on 8. I am a straight, Pagan female, and also ordained to perform marriages. I believe that when one is lucky enough to find love, no matter the gender, they should be free to marry and be as miserable as the rest of us! Also citing the U.S. Constitution, dosn't EVERYONE have the right to persue happiness? Citing the Christian belief, shouldn't we love our neighbors as ourselves? Oh, and not all religions hold all others in contempt, but just remember; the last time we mixed church and state, people were burned at the stake.
