Texas secession petition growing quickly, may require response

UPDATE: Governor Rick Perry stated this morning that he does not support the Texas secession movement, according to The Washington Post.

A previous version of this article declared that secession is “unconstitutional.” It has since been changed to read “secession is unprotected by the US Constitution,” which is more accurate.

The Texas petition to secede from the United States may grow to the point at which it requires an official response from the Obama Administration soon.

Since Election day, more than 19 states have officially started petitions seeking outright Civil War-era secession from the United States of America. Texas secession is a long-running joke you hear about as often as various threats to move to Canada when an election doesn’t go one’s way, but the Texas petition this time around is different, primarily because it has surpassed the required number of votes needed to elicit a response from the White House: In this case, President Obama’s White House.

Other states petitioning for secession: Arkansas, South Carolina, Georgia, Missouri, Tennessee, Michigan, Colorado, Oregon, New Jersey, North Dakota, Montana, Indiana, Mississippi, Kentucky, North Carolina, Alabama and New York. Since secession is unprotected by the US Constitution, these states likely aren’t going anywhere, but Texas is at least racking up the signatures needed to get an official response.

The White House’s self-imposed rule for an official response to a state petition is that it acquires over 25,000 signatures within 30 days. The Texas secession petition has gotten 25,318 in under a week.

Here’s part of the Texas secession petition:

“The U.S. continues to suffer economic difficulties stemming from the federal government’s neglect to reform domestic and foreign spending. The citizens of the U.S. suffer from blatant abuses of their rights such as the NDAA, the TSA, etc. Given that the state of Texas maintains a balanced budget and is the 15th largest economy in the world, it is practically feasible for Texas to withdraw from the union, and to do so would protect its citizens’ standard of living and re-secure their rights and liberties in accordance with the original ideas and beliefs of our founding fathers which are no longer being reflected by the federal government.”

The Obama Administration could dodge the official rules for a response, by the way:

“To avoid the appearance of improper influence, the White House may decline to address certain procurement, law enforcement, adjudicatory, or similar matters properly within the jurisdiction of federal departments or agencies, federal courts, or state and local government in its response to a petition.”

My guess? The Texas secession petition goes nowhere, no matter how many signatures it gets. But you never know what might catch the newly re-elected President Obama’s eye.

    Firstly, its not unconstitutional, there is nothing in the Constitution expressly forbidding it and in fact one could argue that the rights to leave or change governments is part of our organic law, that is to say, stemming from the Declaration of Independence and the pre-amendment Constitution.

    *sigh* hmmm form a government based on social conservatism and oppose egalitarianism(equality, women's rights) while combating rationalism(reason), positivism(Truth in scientific Knowledge) and liberal democracy. This government would believe in social dawinism and wants to succeed from the union because they see the re election of Obama as the "organized minority" will to dominate and rule over the "disorganized majority". This new nation that they hope to create will be based on Nationalism and corporatism which seeks an alliance between corporations and the state, thereby putting the economic power of the country under the control of the state to most effectively provide military equipment for national security and economic stability, thus lowering national unemployment and combating communism while officially advocating resolution to domestic class conflict within a nation to secure national solidarity.     I doubt that this will happen, Texas has to strong of an economy with the most oil refineries and energy influence, some of the best medical in the world, more Fortune 500 companies than any other state, Johnson Space Center, Space interestes and the home to the gateway of the airforce. For all US federal interests to live the state would cost to much and they would lose the taxes of one of the largest states with 3 of the countries largest cities within its borders. It would not be feisable for the goverment to allow it.

    I am afraid the writer of this document probably needs to do a bit of research on the posed opinion that a state can't sucede. In fact there is no mechanism currently in the Constitution to do so. Furthermore, the Supreme Court did partially hold up the idea or concept of sucession as viable. So, in fact like a bad marriage Texas can sucede and unlike other states that would have to ask the union to do so this state is not exaclty so incumbered. Opinion based stories are just that poorly researched and usually badly posed. Do us and yourself a favor get educated on the subect in total and then properly pose both sides correctly your bias shows and it makes me devalue you as a poster of stories.     This article didn't do the home work on what is legal.Texas is the only state that reserves the right from the Civil War to secede. Texas never surrendered, just agreed to a truce, retaining the right to secede. Be careful with all these ignorant comments,
    Texas is a core part of what is holding this economy together, and their is a lot of disgust with the way America is heading. It probably isn't going to happen overnight but there has been a quiet rage brewing.

Texas Constitution at the time of joining the Union states that Texas is subject ONLY to the US Constitution….NOT the US Congress, NOT the US Supreme Court, NOT the US President.     Every presidential election to come is going to be a Democrat win regardless. Reelecting our President has shown that the needs of the country do not matter to the average American. I would not be surprised if in 2016 the 22nd Amendment gets thrown out the window and he is reelected again. I agree with you that Texas probably will not secede, but at least Texas and the other states that have filed are sending a message to the federal government that states rights matter.

The federal government needs to back off infringing on the rights of citizens…less government. You are right about the GOP needing to restructure.     My guess would be the petitions were submitted after Obama won because that pretty much sealed the fate of the nation and these states know it. It something is broke, fix it.     I think it will catch Obama's eye if enough states follow the path of Texas. However, I do not by any means believe America will just "let go" multiple or even one state because they request. I honestly think the possibility of a fine being delivered because of 'treason'. Either way, for any of this states to actually break away from America is to follow up on this petition and then protest when denied and ect…. to a civil war like atmosphere to gain seriousness about what they want as well as gain the gov eye. I do hope though, if it does go down this path… it would not be violent or involved bloodshed. Rarely does that happen though.

    Do any of you realize how much funding Texas receives from the federal government to sustain their "balanced budget"? A lot, as in 6.4 billion. Meanwhile, their 9+ billion "rainy day" fund is untouched. Individuals in this country must extinguish their rainy day funds (savings) and liquidate their assets before they can receive any forms of assistance, so why should the states be held in a different light?     I seem to fnd this pounding on Texas only as racist when 19 other states have also filed. Texas has been its own country before and we still fly our country flag. Texas is the only state in the union that has kept an active militia. They are called The Texas Rangers. AS for mlitary our soldiers would come home thus giving us a military presence. The oil from Canada is not refined as is being sent to one of our refineries to process. You can have no oil, diesel, or gasolne wthout it. I was born here in Texas and I live here. I am proud to be a Texican. We lived side by side with the Mexican Indians and did very well. We live with them still. I believe someone should do their history on the 42nd parallel and see what the government stole from us. You should also know that California is a union state that supplied gold to them so they could win the war. The Teas constitution gives us the right to leave if we wish. True Texicans will stay.     Texas does have the right to leave the union, it was a part of the treaty that Texas signed with the US Government….Texas was a sovereign nation before it was a state…..I believe Rhode Island and a few others made a proviso in their ratification that they could leave the union if it were unsatisfactory…in another vein. The civil war does not invalidate the constitutionality of these ideas. Might does not make right.

    Al Hartley, then the US Government agreed with this "Treason" when they signed on to the treaty making Texas a state and a few of the founding colonies who ratified the constitution did so with the proviso that they could leave.

First off, your gas and heating oil prices would almost double because we'd take care of our own first, and since 70+% of the nation's gas and heating oil is done right here, well, you do the math.     Do not believe that the people of TX, want to secede because their guy lost. It is because of the lack of regard the Obama Administration has placed on the US Constitution. For example, Federal regulated mandatory health care. If it were mandated by the state, then it would be constitutional.     It did not read that way to me, I clearly stated that Texas does not have the right to secede, only the right to break up into several states. And, I did sign the petition. Not for racial reasons as most would expect, but for economic reasons. In the last 4 years every American has been the victim of Obama and the Democrats. Republicans do not even have enough senators in office to fillibuster. How is it that they are still blaming Republicans for not doing their jobs. I do not find it surprising that Obama won. Hell he got 47% of the vote from people that don't pay taxes right now. The other 4% were probably liberals.
    Bottom line is that the United States no longer supports the hard working tax paying Americans. Now I know that not all persons on welfare are bums/lazy. But I can assure you that a large percentage of them are.
    I think that if a person does not work or pay taxes they should not be allowed to vote. It is a right that must be paid for.     I can't say I disagree. Drug tests for welfare is fine with me, but taxpayers will balk at that once they understand how much it will cost. You can't guarantee it would knock enough people off welfare rolls to justify the expense. In fact the mechanism ie: sucede at least to my knowledge doesn't exist. I had to mispell it on purpose again because I love poking fun at the spelling police :). However, the Supreme Court has held up at some level that indeed based on how the consitution (The US) is written that it can be implied that at least Texas does have the right to secede (note correct spelling) but other states do not because they would have to actually ask the union as a whole to do so. My concern comes that when you follow the petition to the White House and read on people's posts they seem to be under the impression this is in fact a non-violent way to protest and to be honest I disagree. This is a first step in a process….. I don't think anyone is really interested in what Obama has to say because they are tired of all his rhetoric. He has an agenda you see and if he drives down the living wage you have to ask what is the advantage to that? Level the playing field? I am not an economist… but I would find it most interesting to get the perceptions of one.

They not only have the inclination to secede, they can make it happen within a generation. You guys should join forces to make your secession more of a reality.

    NASA is dead
    Agriculture, feed yourself, your family, your community make money later
    Texas has a large amount of money, and resources to FORCE the US to give it the resources for those ships (who needs planes for a border crossing)?
    I'm from Florida, and I support the succession in the states, unless the government makes drastic changes for the benefit of those who suceed, not just those who are unemployed, low employed, or who just don't try.

    Texas could sustain itself, and after one state falls its a standard domino effect more would follow, I could see there easily be a split in the country, the liberals in the far east and west, the south to midwest as conservatives, if texas seceeded sucessfully, then its likely several border states may join its bold move.

    Posse comitatus has not been suspended. In fact, in 2008 the president's power to use military forces domestically was limited further. The defense authorization act in 2012 simply gave the president authority to subject a "person who was a part of or substantially supported al-Qaeda, the Taliban, or associated forces that are engaged in hostilities against the United States or its coalition partners, including any person who has committed a belligerent act or has directly supported such hostilities in aid of such enemy forces" to martial law. It doesn't give anyone free reign to use the military as a domestic police force.

    I'll sure be glad in a few years when Texas turns Democrat Blue. I hope all of you are ready for that day and have already began searching for a new place to live.
    This is the best example I have seen lately for how poorly educated Texans are by their public school system. But that's the result when you'd rather pay for fancy football stadiums than improved schools and more teachers.

    I hold the view that any nation which was found on revolution and secession, cannot itself legally outlaw either thing. What is legal and what is not is for the people to decide, such as it was for the break-away colonies. Texas was a Republic, and could be again if she chose that.
