Is Gay Marriage Illogical? Kentucky Family Judge Compares It To Jumbo Shrimp


USA Today reports a Kentucky family judge named Tim Philpot who works the Fayette Circuit Court claims that gay marriages are an oxymoron similar to a “magnificent Chihuahua” or a “jumbo shrimp.” Despite frequently being the judge who presides over gay adoptions, claims that all homosexual relationships are “sterile” and “just for entertainment.”

USA Today goes on to report that while this family judge from Kentucky claims to “love homosexuals,” he said that the Supreme Court’s decision to legalize gay marriages last year was “pretty close to insane” while he was addressing the Francis Asbury Society in Wilmore, Kentucky on September 8. He went on to warn that legalizing gay marriages in the state of Kentucky was opening the door to polygamy.

Tim Philpot, who is also the former state senator to the state of Kentucky, also believes that legalizing gay marriage is going to have the worst impact on the way it affects children.

“Now kids not only have to decide which girl to date, or which boy to date, they’ve got to decide which gender to date. There is not a 12-year-old or 13-year-old or a 14-year-old in Fayette County, Ky., that doesn’t have to decide ‘Am I gay or am I straight?’ Man, I’m telling you, that is some kind of abuse.”

This family judge from Kentucky believes that making gay marriages legal is putting way too much pressure on children as the question of who you want to date should not be so complicated.

According to the Courier-Journal, Chris Hartman, the director of the Fairness Campaign, believes that this family judge has absolutely no idea what it means to be part of the LGBT community.

“[He] clearly has a fundamental misunderstanding of what it means to be LGBT, chalking it up to some arbitrary choice children must make. Personally, I would never want Mr. Philpot making decisions about my family, given the fact he has deep disrespect for LGBT people and their families.”

Chris Hartman believes the biggest issue with this Kentucky family judge’s way of thinking is the fact that he believes being gay or being straight is a choice and not a feeling. Hartman does not believe this is a judge who should be making decisions for any family in the LGBT community regarding marriage, divorce, or adoption given his blatant disrespect for families within this community.

While the Kentucky family judge was on vacation in Ireland, he sent an email saying that in the 13 years that he has been a judge a person is going to be hard-pressed to find a single complaint about him regarding his fairness in court sessions involving the LGBT community. Even lawyers who have represented gay clients in Philpot’s courtroom claim he has been very fair to them.

Ross Ewing has represented hundreds of people who have stood before this family judge. Ross claims to have never seen him make a judgment based on his opinion and their sexual orientation. He feels as though the judge has always looked at the facts of each case and made a ruling based on nothing more than the facts.

Keith Elston, who has represented many gay adoption hearings in Philpot’s court claims that the judge does sometimes ask a few more questions to a gay or lesbian couple than he would if the couple were straight. He, however, does not feel that any of the questions our out of bounds or a reflection of the judge’s personal bias on the matter.

The chairman of Lexington Fairness, Josh Mers, claims he has never had anyone complain about this Kentucky family judge discriminating against them because they were gay. While Keith Elston says he is concerned about the comments this Kentucky family judge has made regarding gay individuals and their relationships, he also says the judge, technically, “has a right to say whatever he wants to say.”

Federal courts, including the one in the state of Kentucky, have ruled that both judges and judicial candidates have freedom and the right to express their opinions. This is, however, as long as they can set their personal opinions aside when ruling on a case.

Martin Cothran, who is an analyst with the Family Foundation of Kentucky claims that it would be a double standard for anyone who supports same-sex marriages to be upset by what the judge has said about gay marriages in public because he can put his opinions aside and make fair rulings in courts.
