Also can you imagine if he was like "fine here's the test" and then 10,000 other girls say "wow I want Justin to take a test for me." Ken, you might want to read California Penal Code: Section 261.5 again. The 3-year gap is still statutory rape, it's just a misdemeanor statutory rape charge.

Specifically: § 261. 5(b)-(d) which states: Anyone who engages in an act of unlawful sexual intercourse with a person under age 18 and the actor is not more than three years older or three years younger, is guilty of a misdemeanor.
