Police involved in the Gabriel Aubry and Olivier Martinez brawl claim that the instigator was none other than Aubry. While no criminal charges are expected to be filed, officers in their report of the Thanksgiving dDay Halle Berry fight claim Aubry started the fight.
According to the report:
“Suspect [Gabriel] arrived at victim’s [Olivier] residence for child custody exchange. Suspect and victim engaged in verbal altercation. Suspect became upset and attempted to punch victim’s head but missed and struck victim’s right shoulder instead. Victim returned with 3 punches to the suspect’s head, causing him to fall to the ground. Victim’s fiance [Halle] notified police.”
Following the fight, both Olivier and Gabriel claims they did not start the brawl. Police disagreed with Gabriel and reported that Olivier acted in self defense:
“Victim defended himself and punched the suspect.”
Police also note that Gabriel Aubry made no mention of death threats made against him by Olivier Martinez. In the days following the Thanksgiving fight, Aubry was adamant that Olivier had threatened to kill him ahead of their brawls. Officers on the scene claim to have asked Aubry if he had more info to provide, and, on several occasions, he said nothing else had happened to incite the fight.
Because the case of “mutual combat” does not necessarily have proper evidence, neither participant is expected to be criminally charged.
The big loser even without criminal prosecution could be Gabriel Aubry, who is still fighting for more parental rights following his divorce from Halley Berry.
