Kelly Rutherford was finally allowed to reunite with her children, Hermes, 8, and Helena, 6, a month after her ex-husband accused her of abducting them.

According to People Magazine, Rutherford was spotted in France eating lunch with her kiddos following a court hearing on Thursday. A source said the couple’s current joint custody arrangement remains the same, with the kids living primarily with their father, German businessman Daniel Giersch, in Monaco. However, another court date has been set for October 26.

“Everybody agrees that it’s best that the children be with both parents, and Kelly’s enjoying being with them,” the source revealed.

Rutherford has desperately been trying to bring Hermes and Helena back to the United States, where they were born, since Giersch was refused re-entry into the United States, due to his U.S. visa having been revoked in 2012. At the time, a judge ordered that the children should live with him in France, according to a previous report by the Inquisitr.

“I’ve always wanted my kids to have a relationship with him, and I’ve really only encouraged that all along. When I went into court, I never asked for money, and I never asked for full custody,” Rutherford said in April. “I just wanted what was right for them and their well-being moving forward. And what happened over the next six years was the most surreal, bizarre, unimaginable thing.”

“I can sit here and tell you how often I cry … I can tell you how it feels to leave my kids in a foreign country … to see them after not seeing them for weeks on end,” she added. “Not being able to drop them off at school … pick them up from school … dress them … smell them … hug them.”

Last month, after spending five weeks with her children in New York, Kelly Rutherford refused to return them to their father, who then in turn accused her of kidnapping. The judge later ordered Kelly to surrender the children and their passports, and they flew back to Monaco with their paternal grandmother.

According to Today, legal analyst Lisa Green said Kelly needed to apologize for her wrongdoing in court.

“She needs to start the ‘Kelly Rutherford judicial apology tour,”’ Green said. “She needs to say, ‘I was misguided, I shouldn’t have done what I did, and I’ll never do it again.’ Even if she does, her ex-husband can rightfully say, ‘I’m not sure this won’t happen again. I want supervised visitation. I’m not even sure these children should be allowed to go to America in the near future.’”
