Kim Zolciak Sued By Kandi Burruss Over ‘Tardy For The Party’


Kim Zolciak is being sued by Kandi Burruss over the song “Tardy For The Party.”

Burruss, who is currently starring on Real Housewives Of Atlanta, said that she was never properly compensated for her work on the song.

“Tardy For The Party” is credited to Zolciak’s daughter but Burruss claims that she was the one that wrote it. Burruss is suing for “damages for copyright infringement due to Defendants’ unauthorized and unlawful licensing, distribution and sale of Plaintiffs’ creative works, namely a sound recording embodying a performance of a musical composition entitled ‘Tardy for the Party.'”

Burruss, whose is being represented by her co-star Phaedra Parks, is also asking for a temporary restraining order to prevent future sales until the lawsuit is settled.

The drama surrounding “Tardy For the Party” has been brewing for years and was a hot topic during the show’s third season in 2010.

Burruss wrote on her Bravo blog at the time: “I hardly got anything from ‘Tardy For The Party.’… I totally wrote the version that everyone knows and is for sale all by myself.”

Burruss says that she graciously allowed Zolciak and her daughter to take a writing credit and also said that she allowed the song to be played on Bravo for free to drive on sales. But despite Burruss’ kindness, she claims that she got screwed on the deal.

Burruss wrote: “I really blame myself, because I didn’t handle my business correctly… I should’ve put what our agreement was in writing from the beginning so there wouldn’t be any confusion.”

And in case you haven’t heard it yet, this is the song at the center of the drama.

Burruss has said in the past that she was paid a $4000 fee for the song but hasn’t received any royalty money. Burruss claims that she had a “verbal agreement” to split all royalties for the song, which sold over 100,000 copies, with Kim.

Kim responded to the lawsuit on Twitter saying that she overpaid Kandi and that she doesn’t owe her a dime.

Kim will be starring in her own spin-off called, yes, “Tardy For The Party,” this April.
