Kris Humphries Is The ‘Presumed’ Father Of Kim Kardashian’s Baby


Kris Humphries is the “presumed” father to Kim Kardashian’s baby — at least, that’s according to Californian state law.

TMZ reports how, through the eyes of California’s Family Code, estranged husband Kris Humphries is presumed to be the father of Kardashian’s baby because the two are still legally married.

After just 72 days of marriage, Kardashian filed for divorce from Humphries way back in October 2011. However, the divorce is still not official, and California’s Family Code presumes a man is the natural father of a child if “he is or has been married to the mother, and if the baby is born during the marriage or within 300 days after death, annulment, declaration of invalidity, divorce or after a judgment of separation is entered by the court.”

Of course, Kris Humphries isn’t actually the father. Humphries and Kardashian have barely been in the same room since December 2011, so it’s probably safe for Kanye to keep calling Kardashian his “baby mama” as he did at one concert last week.

While Kardashian continues to be “sickened” waiting for her and Humphries’ judgment of separation to arrive, she can clear up the misunderstanding and get Kanye recognized as the presumed dad with “clear and convincing” evidence such as a DNA test. The law can be a pain, it turns out.

It’s widely assumed that Kim and Kanye’s baby was conceived in Rome three months ago when Kardashian celebrated her birthday. After announcing her pregnancy news in a New Year’s Eve entry on her blog, celebrity pals and relatives queued up to congratulate Kardashian:
