Chris Gaither was alone in his home and petting his dogs when he heard a strange noise on the vicinity of his home. Like every 11 year old, Chris was naturally scared and grabbed a knife for his safety and made attempts to steady himself.

According to Chris, the suspected invader first appeared on the stairwell, but when Chris confronted him, he ran back up upstairs. The man reappeared after a few moments, and this time he was holding a gun, Chris told WVTM-TV.

“When he was coming down the stairs, that’s when he told me he was going to kill me, f-you and all that,” Chris said.

Instead of running from the scene, Chris chose to update his arsenal by picking up a 9mm handgun that was in the home.

The intruder made it out the front door with a hamper in hand. That’s when Gaither started firing off bullets. The intruder started running frantically and was about to jump a fence in the front yard when Gaither’s 12th and final shot hit him in the leg.

“I shot through the hamper he was carrying,” Gaither said. “It was a full metal jacket bullet. It went straight through the back of his leg. He started crying like a little baby.”

According to the Washington post, Chris also said that he threatened to kill the man and ordered him to get out of the house.

“I guess when I pulled the gun out on him he didn’t think it was a real gun cause he didn’t worry about it,” Chris told the station. “He just kept on walking.”

The gun not only turned out to be real, but Chris also turned out to be a practiced shooter. Chris said that his stepfather had been giving him shooting lessons.

As soon as the man was comfortably out of his house, Chris fired a warning shot. The man was carrying a stolen laundry hamper and immediately began running after hearing the shot. Chris emptied the magazine, firing off 12 rounds while the intruder had desperately crawled to the family front yard.

The final shot hit the intruder and brought him to the ground, Chris said.

The man was taken to hospital, but the injuries were not life threatening. Talladega Police are investigating the incident, but have not identified the suspect, according to WVTM-TV.

A sign hanging on Gaither’s fence outside the house reads, “Basset on guard.” It turns out, there’s more than a dog protecting the house on Creekside Circle.

“I hope you learn your lesson coming to this house trying to steal stuff,” Gaither said.

Alabama’s stand your ground law from 2006 states that a person is justified in using deadly physical force if they believe the other person is:

  • About to use unlawful deadly physical force.
  • A burglar about to use physical force.
  • Engaged in kidnapping, assault, robbery, or rape.
  • Unlawfully and forcefully entering a home or car, or attempting to remove a person against their will. (There are exceptions for people who used to live there and are under no injunctions or domestic protection orders.)
  • Breaking into a nuclear power plant.

In 2013, Alabama legislature added another detail explaining that a person is also justified in the use of deadly force against someone who is “using or about to use physical force against an owner, employee, or other person authorized to be on business property when the business is closed to the public while committing or attempting to commit a crime involving death, serious physical injury, robbery, kidnapping, rape, sodomy, or a crime of a sexual nature involving a child under the age of 12.

Chris referred to the man as “a meth-head” in his 30s. He also added that he had robbed them before and is known for targeting other homes in the area.

“I hope you learned your lesson from coming to this house trying to steal stuff,” Chris said. “Be brave, you’ll be okay,” he added. “Trust God.”
