Matthew Fox To Avoid Jail For DUI If He Completes Alcohol Treatment Program

Matthew Fox looks set to avoid jail in his Oregon DUI case, but there’s a condition attached: he has to successfully complete a court diversion program.

The 45-year-old actor pleaded no contest on June 1 to one count of driving under the influence of intoxicants. The actor, who wasn’t required to appear in court, entered the plea to Circuit Judge Roger de Hoog in Bend, Ore.

As part of his the plea deal, Fox must complete a drug and alcohol treatment program. He’s also been banned from drinking for a year – if he succeeds at both, the case will be considered wiped out.

Deputy District Attorney Cliff Lu told People:

“He has to go to an evaluator for alcohol [abuse] and complete any recommended treatment program.”

Lu added the case was “certain to be dismissed” in the event that Fox completes his treatment.

The Lost star was arrested on May 4 for drunk driving in Bend, Oregon, where he lives with his wife of 10 years, Margherita Ronchi, and their two children, daughter Kyle and son Byron. At the time he was driving early in the morning to a fast food restaurant.

In further good news for Fox, another legal problem seems to have disappeared. Bus driver Heather Bormann has dropped her lawsuit against the actor that alleged he assaulted her. Fox had been accused of punching Bormann in the chest and pelvic area on August 28, 2011.

Former Lost co-star Dominic Monaghan, who played Charlie to Fox’s Jack in the ABC series, later accused Fox of “often” beating women in some frank tweets made last week. Shortly after Monaghan’s accusations went viral, a spokesperson released a denial (complete with questionable ‘joke’) on Fox’s behalf.
