Mother Finds Photos, Videos Of Babysitter’s Sexual Assault On Her Two-Year-Old Daughter

An Arizona man was recently caught sexually abusing a two-year-old girl. According to PIX-11, the little girl’s mother — whose name has not been released in order to conceal the identity of the toddler — reportedly found several lewd cellphone photos and videos of Daniel Boyd Divit sexually abusing her daughter.

The disturbing video showed the toddler propped up on a pillow that matched one found inside the victim’s home as someone performed a sexual act on her. Arizona Central reports that the mother texted one of the horrific cellphone photos, dated July 18, to her phone for evidence before contacting local authorities.

Following the allegations, Divit was served with a warrant, and a forensic search of his phone led to the discovery of 12 additional graphic photos and footage, showing the same little girl with her genitalia exposed while being sexually abused by a man. Throughout the videos, investigators also cited that the toddler was visibly in pain. The files found during the search were dated Aug. 1 and Aug. 8. Those two dates, along with the July 18 files, were all filmed on Saturdays when Divit was babysitting. Investigators also conducted a forensic examination on the toddler. In addition to being able to associate her injuries with Divit, she was also able to identify him.

On Monday, Aug. 10, the 51-year-old was arrested. During the interrogation, Divit admitted to his actions, stating that the photos and videos of the toddler were in his possession. However, according to the police report, he also insisted that he’s “blacked out all those memories and did not remember” the series of events that took place, reports ABC-15. Divit is reportedly facing at least 12 counts of sexual exploitation of a minor and seven counts of sexual conduct with a minor.

According to the Huffington Post, Divit’s case is quite similar to an Ohio daycare case that made headlines back in 2013. Heather Koon was charged with the rape of four children after footage of numerous alleged sex acts were found on a laptop that belonged to her boyfriend, convicted sex offender James Osborne. She admitted that she’d abused the children and filmed the horrific acts because Osborne requested that she do so.

Like Koon and Osborne’s case, Divit’s charges come with steep consequences, but in the state of Arizona he could be facing a much harsher prison sentence. Penalties for the sexual exploitation of a minor, which is a class 2 felony, come with the possibility of a 10-year prison sentence for one single pornographic image.

“An Arizona conviction for sexual exploitation of a minor carries a penalty of a minimum of ten years prison time for each violation. That means 10 years of incarceration for possessing a single pornographic image! If you are caught with more than one pornographic image, each one can add 10 more years to your sentence, because state law requires that the sentences for multiple counts must be served consecutively. If you have downloaded only 10 pictures depicting a minor engaged in a sexual act, you could be sentenced to 100 years in prison! A number of people are currently serving sentences of several hundred years in Arizona prisons for possessing multiple images of child pornography. – Snader Law Group”

Divit is scheduled to appear in court on Monday, Aug. 18.
