Randy Shannon, Former Coach, Sues University Of Miami

Randy Shannon, a former University of Miami coach, is suing his alma mater for breach of contract, saying that they did not pay him all he was guaranteed to get.

Shannon was fired in November of 2010, even though he was under contract until January 31, 2014. According to the ex-coach, the contract included a guaranteed amount per year, even if he was fired. However, according to the lawsuit, Miami reduced the guarantee, because he was fired after less than one year coaching the team.

The lawsuit, filed in the Eleventh Judicial Court of Miami-Dade County on April 27th, goes on to say that nothing in the contract authorized UM to make this change to the guarantee, and also alleges that the university did not give him a promised bonus for the Hurricanes making the Sun Bowl in 2010.

The contract requirements include a stipulation of confidentiality that prevents Randy Shannon from disclosing the exact amount UM should be paying each month, but the lawsuit says that the school has reduced the amount by one sixth. Shannon’s attorney, Jack Scarola, stated that:

“They are taking a credit for what they contend is an overpayment. It’s our position in the lawsuit that they are not entitled to do that.”

Shannon is also claiming that the reduction is being applied to the payments he has been receiving since 2010, causing him to owe money back to the school, in what they now consider “overpayments.” in regards to Shannon not receiving his bonus for the Sun Bowl, Scarola stated that, “Clearly, the team qualified for the Sun Bowl as a consequence of the record established when he was there.”

Randy Shannon has requested a jury trial in the lawsuit.
