Dead Train Victim Being Sued For Flying Body Parts Injury


A 58-year old woman in Illinois has won an appeals court ruling that will allow her to sue a dead teen who was hit by an Amtrak train.

The 18-year-old was in Chicago when he ran out in front of a train in an attempt to catch another train, the teen did not see the 70mph Amtrak coming when it took his life.

According to the Chicago Tribune the boys body parts went flying and a big chunk of his body landed on the 58-year-old nearly 100 feet away on the train platform, knocking her down and breaking her leg and wrist in the process.

The court of appeals ruled that the teens death was “reasonably foreseeable” based on his actions and the court would therefore allow the woman to sue his estate for medical costs and damages.

The plaintiffs lawyer admits that the case is “very peculiar and gory and creepy,” while also acknowledging that it’s a clear case of negligence. As her lawyer put it:

“If you do something as stupid as this guy did, you have to be responsible for what comes from it.”
