Tracy Morgan’s Lawsuit Will Not Be Delayed, Judge Rules In Favor Of Lawsuit


A judge has ruled in favor of Tracy Morgan. Wal-Mart truck driver Kevin Roper hoped the federal case would delay until his criminal case is over with.

According to the Associated Press, the federal judge refused to delay the suit. Comedian and film star Tracy Morgan is trying to sue Wal-Mart after Roper slammed into his limo van on the New Jersey Turnpike over the summer. The crash killed Morgan’s friend and comedian James McNair and Morgan is suffering from a severe brain injury in addition to other ailments from the accident.

According to Morgan’s lawyer, he said that the comedian may not be “the Tracy Morgan he once was.”

Due to the accident on June 7, Morgan suffered a broken nose, ribs, and a leg, in addition to the brain injury. As the Inquisitr previously reported, Morgan is still fighting.

“If there’s a chance for him to be back to the Tracy Morgan he once was, he’s going to try to do that, but we just don’t know because of the severity of the injuries that he sustained and the fact that he had such a severe brain injury.”

As a result of his injuries, Morgan is suing Wal-Mart for negligence since they allowed the driver to operate the vehicle without proper rest.

As for Kevin Roper, the Wal-Mart truck driver is being charged with death by auto assault, but so far Wal-Mart isn’t taking any responsibility for the injuries sustained. Wal-Mart said that those who were involved in the car accident should have all buckled up in the limo.

Initially Wal-Mart was more sympathetic to Morgan’s pain.

“This is a tragedy and we are profoundly sorry that one of our trucks was involved… The facts are continuing to unfold. If it’s determined that our truck caused the accident, Walmart will take full responsibility.”

In the wake of the accident, Morgan’s friends have been sending their support to the comedian. Chris Rock, who directed him in the new film Top Five, said the following of his friend and colleague.

“He’s got physical therapists. There’s a lot of rehab going on. He’s traumatized — his friend died. It’s Tracy — not the most stable guy in the world to begin with.”
