Today in pointless victories comes one for former Noxema girl Rebecca Gayheart and her Gray’s Anatomy spouse, Eric Dane.

The two were featured in a widely viewed sex tape most prominently disseminated on Gawker. The clip, a fairly seedy affair that features the pair engaging in a wild night of sex and smokable substances with Keri Ann Peniche, has been floating around the internet ether since August of last year. Although countless people have screencapped, torrented and saved the footage in that year, Gawker has been tied up in court over it since September of last year.

In a statement, a Gawker spokesperson contends that use of the clip was protected, but the legal wrangling had become too large of a pain in the ass:

“Although we are confident that our use of the video on Gawker was protected fair use, because the posts already had been available to our readers for nearly a year, and because we already had won an important decision from the court striking large parts of the plaintiffs’ damages claims, we agreed to remove the posts as part of a global settlement to avoid the burden of further litigation,” Gawker COO Gaby Darbyshire said in a statement.

In exchange for Gawker pulling the material, Gayheart and Dane will drop their $1m lawsuit against the blog network.

Anna Bambino, a 30-year-old woman from Connecticut wanted a threesome badly.

So badly, authorities say, that she harassed a married couple with whom she was acquainted so intensely she was charged with breach of the peace. Bambino is said to have called the couple no less than six times, “demanding” that they engage in a three-way sex with her. Bambino is said to know the couple through friends, but they have no “real history.” Bambino claims that the calls were made while she was intoxicated.

According to her MySpace profiles, Bambino is alternately listed as single and “married” to a woman named Jenn. After being booked on the charges for breach of the peace, Bambino was released with a written promise to appear in Bridgeport Superior Court.

So Eric Dane, Rebecca Gayheart and dethroned former teen queen Kari Ann Peniche apparently got naked and high and filmed an almost sex tape.

Gawker’s got the video, and explains the basic action contained therein:

In the video (which we edited down from a 12-minute original), we see the apparently inebriated threesome — at one point Gayheart says she needs to lay down because she’s so high — lounging au naturel in the fallen beauty queen’s Studio City apartment, passing around the camera and, for giggles, discussing what their porn names should be. Dane settles on “Tuff Hedemen” (his favorite champion bull rider). Soon the threesome move to the bathroom where the two ladies disrobe and get into a jacuzzi tub while Dane takes over the camera duties.

Boringly, no one has any kind of sex in the video- ostensibly because everyone’s “too high.” Commenters report “drug paraphernalia” on countertops as the camera pans, and at one point Gayheart indicates she has to go “lay down” because of it.

UPDATE: Twist alert! Apparently the video was stolen from Kari Ann Peniche during “Celebrity Rehab” by singer Mindy McCready!
