<p>A 58-year old woman in Illinois has won an appeals court ruling that will allow her to sue a dead teen who was hit by an Amtrak train.</p>
<p>The 18-year-old was in Chicago when he ran out in front of a train in an attempt to catch another train, the teen did not see the 70mph Amtrak coming when it took his life.</p>
<p>According to the <a href="http://www.chicagotribune.com/news/local/ct-met-train-fatality-suit-20111229,0,1641941.story" target="_blank"><em>Chicago Tribune</em></a> the boys body parts went flying and a big chunk of his body landed on the 58-year-old nearly 100 feet away on the train platform, knocking her down and breaking her leg and wrist in the process.</p>
<p>The court of appeals ruled that the teens death was &#8220;reasonably foreseeable&#8221; based on his actions and the court would therefore allow the woman to sue his estate for medical costs and damages.</p>
<p>The plaintiffs lawyer admits that the case is  &#8221;very peculiar and gory and creepy,&#8221; while also acknowledging that it&#8217;s a clear case of negligence. As her lawyer put it:</p>
<blockquote><p>&#8220;If you do something as stupid as this guy did, you have to be responsible for what comes from it.&#8221;</p></blockquote>
<p>Do you believe that what the teenager did was negligent and stupid or just plain stupid?</p>

<p>Mike Meier, a DC defense attorney, was once considered a champion of BitTorrent users rights and was even on the list of lawyers recommended by the Electronic Frontier Foundation&#8217;s web site. He also wasn&#8217;t shy about calling out copyright holders and their &#8220;extortion racket&#8221; as he called it.</p>
<p>Well it seems that Mike has decided to cross over into the dark side in a big way joining other copyright troll lawyers who are suing anyone they can when it comes to suspected copyright infringement. I say suspected because no-one yet has come up with an absolutely foolproof way to identify infringers by their IP addresses.</p>
<p>So far Meier has sued more than 1,000 BitTorrent users, or at least that is what he proudly boast on his site. As you can see from the top image prior to his conversion Meier was on the side of the consumer but now his web site advertises about how he can help you accept your punishment and pay up.</p>

<p>This from the man who once said in an interview that it was his opinion that copyright trolls were just the bill collectors for the movie industry and that they were just extorting money.</p>

<p>If there ever was a Charlie Brown of the tech world one would have to vote for it to be RIM. No matter which way it turns lately the company seems to be constantly kicking at the football but like Charlie it is forever missing and ending up flat on its back.</p>
<p>As part of its efforts to build back some good press and keep the Blackberry alive in the ever increasingly competitive smartphone world RIM announced its next generation operating system for its smartphones; however no sooner than it breathed the word &#8220;BBX&#8221; than it found itself being served with a lawsuit from a company that already owns a trademark for &#8216;BBX&#8217;.</p>
<p>Yes it seems that RIM went ahead and named its new smartphone operating system, that was based on QNX,  as well as the developer tools for it, then a company in New Mexico by the name of  Basis International claimed that RIM was infringing on their trademark.</p>
<p>So what does Basis International do?</p>
<p>Well, it just so happens that they develop and market tools for developers which, as Basis points out creates confusion in the market place &#8211; one of the needed ingredients for a successful trademark lawsuit. Basis International points out that they have already been fielding calls from concerned customers regarding their BBX product and whether RIM had bought it from them.</p>
<p>RIM is claiming that there is no confusion over the name and that they came up with the BBX name by combining their Blackberry name and their QNX operating system name.</p>
<p>Ya, good luck with that one in court RIM.</p>

Thirty years after he retired from the ring, Muhammad Ali is facing a new bout &#8211; this time in a courtroom. The 69-year-old boxing legend has filed a lawsuit against a couple who sold him his Kentucky mansion, alleging the property is beset by problems.</p>
<p>The home in Louisville was snapped up by Ali and his wife, Yolanda, in 2006. The sprawling mansion estate cost the Alis a cool $1.87 million, but they claim they have since found several structural issues. <a href="http://www.tmz.com/2011/10/12/muhammad-ali-yolanda-lawsuit-sues-kentucky-home-louisville-broken-leaky-roof-chimney-mold-decking/?adid=rr_tmzsports">TMZ</a> reports that the sporting icon is seeking unspecified damages from Patrick and Beverly Lancaster.</p>
<p>Amongst the alleged faults with the home are a leaky roof and chimney, improper ventilation, mold issues, and structurally defective decking. According to Ali, the Lancasters kept the problems to themselves when selling the house.</p>
<p>An attorney for Patrick and Beverly Lancaster told <a href="http://www.wdrb.com/story/15681576/muhammad-ali-sues-former-owner-of-his-louisville-mansion">WDRB</a> that the couple &#8220;was totally surprised&#8221; by the lawsuit, claiming the Alis had plenty of chances to order an inspection of the home:</p>
<blockquote><p>&#8220;There are no serious defects with the home. The house is a 10-year-old home. A normal Greater Louisville Association of Realtors contract was used for the sale, and the purchasers had every opportunity to have the home inspected at the time.&#8221;</p></blockquote>

<p>A recent U.S. Treasury report shows an increasing number of lawsuits surrounding mortgage-backed security. The study also found that when lawsuits are not filed investors are making other demands to recover their investments.</p>
<p>According to the department&#8217;s Financial Crimes Enforcement Network  29,558 tips regarding mortgage fraud were reported from April-to-June 2011, that number is 88% higher than the 15,727 reported cases in Q2 2010.</p>
<p>The study revealed that a large number of tips during the second quarter involved mortgages that closed during the height of the real estate bubble.</p>
<p>According to the agency tips often involve cases of fake documentation that followed debt-elimination scams. In many cases the fraudulent use of Social Security numbers lead to different types of &#8220;suspicious activity.&#8221;</p>
<p>Lawsuits stemming from the fraud extended all the way to the top ranks of the U.S. Government and include 17 cases filed on September 2 against the world&#8217;s <a title="Gold Hits Record High on New Recession Fears" href="http://www.inquisitr.com/135360/gold-prices-august-2011-record-high-stock-prices-drop/">biggest banks</a>.</p>
<p>According to records:</p>
<blockquote><p>Bank of America Corp., JPMorgan Chase &amp; Co., Goldman Sachs Group Inc., Citigroup Inc., Morgan Stanley, Ally Financial Inc., formerly known GMAC LLC, Deutsche Bank AG, First Horizon National Corp., General Electric Co., HSBC North America Holdings Inc., Nomura Holding America Inc., and Societe Generale were all accused of selling mortgage-backed securities to Fannie Mae and Freddie Mac based on faulty documents.</p></blockquote>

<p>Typically when businesses move to acquire another company it is pretty smooth sailing, even if the deal has to be approved by various US agencies. Even when IBM sold off its laptop business to the Chinese company Lenovo there wasn&#8217;t much more than a cursory overview from those government agencies responsible for watchdogging this type of  deal.</p>
<p>So it is no surprise that AT&amp;T figured that their move to acquire competitor T-Mobile would just slide through regardless of the uproar that came from those pesky consumer groups.</p>
<p>Well, hell has frozen over folks because in <a href="http://www.justice.gov/opa/pr/2011/August/11-at-1118.html">a surprise move the Department of Justice</a> is suing to block the acquisition of T-Mobile by AT&amp;T using the most obvious,and probably very truthful argument that this deal would &#8220;substantially lessen competition&#8221; in the wireless market.</p>
<p>This lawsuit has apparently come as a total surprise to AT&amp;T who thought everything was all hunky-dory after several meetings with the DoJ. <a href="http://www.bloomberg.com/news/2011-08-31/u-s-files-antitrust-complaint-to-block-proposed-at-t-t-mobile-merger.html">According to Bloomberg</a></p>
<blockquote><p>“We have met repeatedly with the <a href="http://topics.bloomberg.com/department-of-justice/">Department of Justice</a> and there was no indication from the DOJ that this action was being contemplated,” Wayne Watts, AT&amp;T’s general counsel, said in a statement. He said the company intends to fight the litigation.</p></blockquote>
<p>This lawsuit could be one of the most costly ones that AT&amp;T has been involved in because if the acquisition is successfully blocked it would mean that AT&amp;T would have to pay T-Mobile a $3 Billion cancellation fee so it is no surprise that AT&amp;T moved quickly to counter the announcement of the lawsuit by the Department of Justice by saying that they will fight this all the way.</p>
<p><a href="http://gigaom.com/broadband/att-will-fight-for-its-right-to-t-mo/">As noted by Stacey Higginbotham at GigaOM </a>the reasons the DoJ stepped in like this are inconsistant with past cases .</p>
<p>A quick read of <a href="http://gigaom2.files.wordpress.com/2011/08/attcomplaint.pdf">the complaint</a> shows that the DOJ looked at the merger not at a local level as has historically been the case in wireless merger agreements, but with an eye toward how this affects wireless coverage across the nation. Significantly, it realized the value of mobile data and competition in nationwide mobile broadband access as a reason that this deal would be harmful.</p>
<p>I don&#8217;t know about you but I&#8217;m going down to the grocery store and stock up on popcorn because this whole thing just started to get interesting.</p>

<p>Dick Clark Productions and the Hollywood Foreign Press Association are officially going to trial to determine who has the rights to negotiate television deals on behalf of the <a title="Avatar Wins Golden Globe For Best Motion Picture Drama" href="http://www.inquisitr.com/57567/avatar-wins-golden-globe-for-best-motion-picture-drama/">Golden Globe Awards</a>.</p>
<p>A U.S. District judge decided to send the case to trial after Dick Clark Productions extended its agreement with NBC to air the pre-Oscars award show through 2018, while the Hollywood Foreign Press Association sued them in November, claiming that the production company did not have the right to make that long-term deal.</p>
<p>Judge Valerie Baker Fairbank refused to side with either party, instead noting:</p>
<blockquote><p>“The court finds that the disputed portion of the 1993 amendment is reasonable susceptible to the interpretations of both parties.”</p></blockquote>
<p>The judge called for a jury trial to begin Aug. 30.</p>
<p>In a release following that statement HFPA&#8217;s President Aida Takla-O&#8217;Reilly said:</p>
<blockquote><p>“We look forward to proceeding to trial and vindicating our rights.&#8221;</p></blockquote>
<p>While Dick Clark Productions countered their statement by noting:</p>
<blockquote><p>“We firmly believe our position will be vindicated as we were within our contract rights to make the NBC deal,” while adding, “The HFPA knows this all too well and is simply trying to rewrite the contract through litigation.”</p></blockquote>
<p>The ruling could affect the new contract that Dick Clark productions has signed with NBC should the jury find in favor of the Hollywood Foreign Press Association.</p>
<p>The ruling is not expected to affect the next showing of the <em>Golden Globe Awards </em>but if it did would you be upset if the Golden Globes ran into issues because of this squabble?</p>

<p>Casey Anthony not only got away with the murder of daughter <a title="Caylee Anthony Law to be Introduced in Omaha" href="http://www.inquisitr.com/126357/caylee-anthony-law-omaha-nebraska/">Caylee Anthony</a>, it looks like she&#8217;s also gotten away with stiffing the court system over her check-fraud case for which she was found guilty and sentenced to time in jail.</p>
<p>Among costs Anthony has not paid include $5,517 in investigative bills which Judge Stan Strickland told her to pay according to a Jan. 25, 2010 court transcript, but then uncertainty about the actual prosecution cost arose and the defense was suppose to work with prosecutors to determine the actual amount owed, a discussion between both parties which has not yet occurred.</p>
<p>Anthony has also failed to pay $348 in court costs, an amount that was due within 90 days of sentencing, although an Arizona man apparently paid $10 towards the fee.</p>
<p>Casey then was suppose to pay $20 per month for supervision costs but that was waived by the Florida Department of Corrections and its Probation &amp; Parole Services because she was in jail and lacked any type of income.</p>
<p>As if Casey not paying her legal bills was not enough, the state picked up $118,847 in legal costs when it was determined she couldn&#8217;t pay her defense costs, even though she had received $5,000 from a private donor and $200,000 from<em> ABC News</em> for her family photos and videos along with $70,000 from attorney Todd Macaluso.</p>
<p>Between private and public funding Casey Anthony has spent $400,000 on her defense over a three-year period.</p>
<p>It&#8217;s still unclear how much of the money Casey Anthony has received from media and other outlets will go to pay for legal expenses, however an investigation is currently being undertaken to determine her fiscal responsibility.</p>

LTD  halted sales in June of their popular <a title="Prescription Drug Prices Set To Tumble As Brand Name Drug Patents Expire" href="http://www.inquisitr.com/128770/prescription-drug-prices-set-to-tumble-as-brand-name-drug-patents-expire/">diabetes drug</a> Actos as the company faces hundreds of lawsuits due to growing suspicion  that the pill raises the risk of developing bladder cancer.</p>
<p>Actos is a top selling diabetes drug in Germany and France but has recently come under pressure from regulators who want more research to be performed on the drug, those pressures and consumer outrage have caused the drugs sales to slip.</p>
<p>While the European Medicines Agency and the U.S Food and Drug Administration (FDA) have issued warnings of their own about the drug, it has not yet been pulled from the market, likely due to the number of diabetes sufferers who rely on the drug. Doctors have been warned not to prescribe the drug to any patients who currently have or who have had bladder cancer.</p>
<p>Mounting lawsuits are bringing the type 2 diabetes drugs future into question, while just a decade ago it was considered a promising once-a-day pill that could help control blood sugar with few side effects, while boosting the effects of some other diabetes drugs. The drug also helps improved the body’s sensitivity to insulin so patients can receive fewer injections.</p>
<p>Actos took the No. 1 diabetes pill sales spot from Avandia when that drug in 2007 was found to sharply increase the risk of heart attacks, leading the drug to be banned in the European Union.</p>
<p>With hundreds of lawsuits filed and thousands more expected around the world, there&#8217;s a chance that the drug which sells nearly $5 billion worth of pills per year may go the way of Avandia.</p>

<p>In a statement to the press HTC&#8217;s general counsel Grace Lei told Jobs and his team that &#8221;HTC is disappointed at Apple&#8217;s constant attempts at litigations instead of competing fairly in the market.&#8221;</p>
<p>The statement comes as Apple has launched a second attack on HTC, asking the courts to block devices from the Taiwanese company, while at the same time fighting it out with Samsung, GetJar and Amazon over various patent issues.</p>
<p>In the meantime, Apple came to the mobile game late and there were thousands of patents already being used by other mobile phone manufacturers who could attempt to offer Apple a bit of backlash over their recent attempts to stifle competition through various lawsuits.</p>

<p>Not surprising, the website Twiter.com hosts content that is visually similar to Twitter, and could ostensibly attract less-savvy web users who may not be fully familiar with the Twitter interface. Also unsurprising is the fact that Twitter has filed a case with the World Intellectual Property Organization (WIPO) over the deception.</p>
<p>When you open Twiter.com, nothing majorly nefarious happens to your computer. But the site attempts to collect personal information. After answering three simple questions, Twiter prompts you to select from a bevy of prizes, including a MacBook Air and an iPad and asks for your email and phone number. Ostensibly, after this, they spam the hell out of you.</p>
<p>Twitter has pursued similar miscreants in the past, <a href="http://fusible.com/2011/06/twitter-finally-files-domain-dispute-over-typo-twiter-com/">according to Fusible</a>:</p>
<blockquote><p>The only other case filed to date by Twitter Inc with WIPO involved<a title="Twittersearch.com turned over to Twitter, after domain dispute filed back in Dec. ’10" href="http://fusible.com/2011/02/twittersearch-com-turned-over-to-twitter-after-domain-dispute-filed/" target="_blank"> twittersearch.com</a> back in 2010, a domain dispute that wasn’t decided by WIPO,  but the company still was successful in having the name transferred.  As I reported in February, though no decision had been officially announced by WIPO and the case was cancelled, the registrant of twittersearch.com is now Twitter, Inc.</p></blockquote>
<p>The case is still active, so the outcome is pending. Should people be prevented from this kind of behavior, or do you think the web is a bit more <em>caveat emptor</em>?</p>

<p>A modern live/work condo building&#8217;s association of homeowners in San Francisco <a href="http://www.thestreet.com/story/11135415/1/soma-live-work-loft-building-recovers-14-million-for-faulty-construction.html">recovered significant damages</a> for faulty construction yesterday, allotting around $700,000 per unit for repairs.</p>
<p>Insurance companies for the builder, general contractor and subcontractors funded the settlement, which came about after residents noticed leaking roofs and windows, unstable decks, plumbing problems and cracked stucco. Thomas E. Miller, attorney for the building&#8217;s association, said shoddy building practices were becoming increasingly common in situations like these:</p>
<blockquote><p>&#8220;More builders today are setting up their developments as Limited Liability Company (LLC&#8217;s), folding the company after the project is completed.  Oftentimes, home and condo owners don&#8217;t realize that insurance does exist to cover construction defects even after the builder disappears, declares bankruptcy, or just walks away.&#8221;</p></blockquote>
<p>Miller&#8217;s firm has recouped more than $600 million in damages for clients who have experienced construction defects. Wayne Wilson, the building&#8217;s association president, commented on the settlement:</p>
<blockquote><p>&#8220;We are very pleased with this settlement.  It provides us with enough to fix the problems, and reinforce our homeowners&#8217; investments in this building. Our homeowners were stunned to discover hidden defects after being lulled by representations of the live-work loft lifestyle and superior building components.&#8221;</p></blockquote>
<p>The case was settled in &#8220;record time,&#8221; less than 18 months following the case&#8217;s filing in San Francisco Superior Court.</p>

<p>One of the more frightening aspects of the ever more free exchange of information on the internet is the apparent impulse in many to stifle this open dialogue, particularly many who have a great deal of power, money or influence.</p>
<p>Censorship, of course, far predates the internet. But it seems every day there is a new venue where someone is trying to get someone to STFU. And while the internet is certainly used for spreading misinformation, accidentally or deliberately, should people be allowed to tell a story that is true and correct to their knowledge if the spread of that information stands to harm another individual?</p>
<p>The answer, of course, is yes. But Ars Technica writer <a href="http://arstechnica.com/tech-policy/news/2011/05/all-your-reviews-are-belong-to-us-medical-justice-vs-patient-free-speech.ars">Timothy Lee brings the issue of online reviews</a> and medical reviews to the forefront again with his tale of an inadvertent almost-gagging when seeking a new dentist. Lee hadn&#8217;t planned on reviewing the dentist necessarily, but while filling out the stock-standard medical forms in the new patient intake, Lee noticed something out of sorts and investigated. What he found is a little disturbing and creates a few questions as far as the rights of private citizens to- well, speak. Lee explains:</p>
<blockquote><p>Yelp says Dr. Cirka is one of the best in the Philadelphia area. The receptionist handed me a clipboard with forms to fill out. After the usual patient information form, there was a &#8220;mutual privacy agreement&#8221; that asked me to transfer ownership of any public commentary I might write in the future to Dr. Cirka. Surprised and a little outraged by this, I got into a lengthy discussion with Dr. Cirka&#8217;s office manager that ended in me refusing to sign and her showing me the door.</p></blockquote>
<p>Lee explains that the agreement was supplied by <a href="http://www.medicaljustice.com/internet-libel-physicians.aspx">a group called &#8220;Medical Justice,&#8221;</a> purporting to aggressively defend doctors against frivolous malpractice claims. But on their site, buried in marketing-speak that can almost make you sympathetic to their free-speech objections, is a stance on net reviews that is chilling.</p>
<p>The practice also seems to rely heavily on both patients&#8217; and doctors&#8217; lack of understanding of laws surrounding these issues. Lee describes how the office was unable to explain some very simple implications of the agreement it enters into with patients on a daily basis:</p>
<blockquote><p>I had a long conversation with Dr. Cirka&#8217;s office manager, who insisted that the agreement was not intended to censor the truthful reviews of Dr. Cirka&#8217;s patients. Rather, she said, it gave Dr. Cirka a tool to remove fraudulent reviews. She said they were especially concerned about non-patients (such as competitors, ex-spouses, or former employees) writing fake reviews to damage Dr. Cirka&#8217;s business.</p>
<p>She didn&#8217;t have a good answer when I pointed out that the agreement&#8217;s text didn&#8217;t say anything about fraudulent reviews. She also couldn&#8217;t explain how the agreement could bind non-patients, who by definition will not have signed it.</p></blockquote>
<p>The conversation Lee recounts is really the crux of the issue here- it&#8217;s almost impossible to root out unethical negative complaints without stifling the many others who may have legitimate reason to post an unfavorable review. Recently, a <a href="http://www.inquisitr.com/106550/negative-reviews-doctors/">doctor in Wisconsin brought a defamation suit</a> against a patient&#8217;s son after the man posted a negative review online. The case was thrown out.</p>
<p>Do you find this practice unsettling? Should doctors be able to interfere with information you share outside their offices? Are the limits of HIPAA laws alone enough to place doctors into a protected class immune from online opinion that doesn&#8217;t apply to restaurants, nail salons, bars and other businesses?</p>

<p>Pissed off consumers can take a deep breath and keep ranting, for now- a judge in North Dakota has thrown out a defamation lawsuit brought by a doctor against a man who complained to websites and regulatory bodies about the care received by his father.</p>
<p>Neurologist Dr. David McKee alleged in his lawsuit that the patient&#8217;s father, Dennis Laurion, defamed McKee and his practice in &#8220;false statements&#8221; made to &#8220;the American Academy of Neurology, the American Neurological Association, two physicians in Duluth, the St. Louis County Public Health and Human Services Advisory Committee and St. Luke’s hospital,&#8221; damaging his practice. Laurion contended he was immune from legal action because the statements he made were true.</p>
<p>In an 18-page order, Sixth Judicial District Judge Eric Hylden recognized the influence of the internet on how information such as that shared by Laurion can impact a practice or business:</p>
<blockquote><p>“In modern society, there needs to be some give and take, some ability for parties to air their differences,” the judge wrote. “Today, those disagreements may take place on various Internet sources. Because the medium has changed, however, does not make statements of this sort any more or less defamatory.”</p></blockquote>
<p>McKee&#8217;s suit addressed some of the more subjective claims made by Laurion:</p>
<blockquote><p>In his suit, McKee alleged that Laurion made false statements including that McKee “seemed upset” that Kenneth Laurion had been transferred from the Intensive Care Unit to a ward room; that McKee told the Laurion family that he had to “spend time finding out if [the patient] had been transferred or died;” that McKee told the Laurions that 44 percent of hemorrhagic stroke victims die within 30 days; that McKee told the patient that he didn’t need therapy; that McKee said it didn’t matter that the patient’s gown was hanging from his neck with his backside exposed; that McKee blamed the patient for the loss of his time; and that McKee didn’t treat his patient with dignity.</p></blockquote>
<p>Commenting on the ruling, McKee pointed out that Laurion allegedly made statements to nearly 20 regulatory agencies and websites, and none of the former had taken any action regarding Laurion&#8217;s claims.</p>

Fresh from Sony <a href="http://www.inquisitr.com/105264/here-come-the-lawyers-first-lawsuit-against-sony-over-playstation-hack/">getting slapped with a lawsuit</a>, here&#8217;s news that Beyoncé &#8220;<a href="http://www.inquisitr.com/41460/beyonce-wants-to-make-a-dance-game/">I would love to do some kind of fitness game</a>&#8221; Knowles is being sued for $100 million dollars for abandoning her contract on some kind of dancing game.</p>
<p>The suit is being brought by developer Gate Five, which was working on a dance game called <em>Starpower: Beyoncé</em> before Beyoncé allegedly overdid the starpower and demanded &#8216;new compensation terms&#8217;. Though we&#8217;re yet to hear the perspective of Ms. Knowles (or &#8216;Ms. Carter&#8217; as she&#8217;s referred to in the lawsuit), this doesn&#8217;t make pretty reading:</p>

<blockquote><p>&#8220;Though she had already negotiated lavish  compensation terms to which she was contractually bound, at a critical  moment in the project&#8217;s development made an extortionate demand for  entirely new compensation terms she wanted. When her maneuver backfired and drove away the financier (who found Ms.  Carter too erratic to do business with), she pulled out of the project  in breach of the agreement.&#8221;</p></blockquote>
<p>Further on, there&#8217;s an accusation that the star &#8220;destroyed Gate Five&#8217;s business and  drove 70 people into unemployment, the week before Christmas,&#8221; and then this:</p>
<blockquote><p>&#8220;Her actions were so unscrupulous that her then manager (who is also her  father) renounced them, while a senior executive of the company that  agreed to finance the project condemned her conduct as &#8216;morally reprehensible.&#8217;&#8221;</p></blockquote>
<p>NOW JUST HOLD IT. You mean to suggest the lady who <a href="http://www.guardian.co.uk/lifeandstyle/lostinshowbiz/2010/jan/08/beyonce-colonel-gaddafi-son">charges millions to perform sets to murdering dictators</a> is the owner of shaky morals? Why, I shan&#8217;t hear a word of it!</p>

<p>Sony&#8217;s PR nightmare over its hacked PlayStation Network just took its next logical step: the first lawsuit being filed against the company. If you haven&#8217;t been following, Sony&#8217;s <a href="http://www.inquisitr.com/tag/psn-down/">PlayStation Network has been down</a> for over a week now, with the console maker <a href="http://www.inquisitr.com/105133/sony-credit-card-info-may-have-been-leaked-in-ps3-hack/">finally admitting on Tuesday</a> that user information and credit card numbers may have been compromised.</p>
<p>That&#8217;s left around 77 million PSN users with potentially stolen credit card details, and PS3 owner Kristopher Johns of Birmingham, Alabama is the first to take action, accusing Sony of not taking &#8220;reasonable care to protect, encrypt, and secure the private and sensitive data of its users.&#8221;</p>
<p>He also claims the company took too long to warn consumers their data has been exposed. Johns says Sony did not allow customers &#8220;to make an informed decision as to whether to change credit card numbers, close the exposed accounts, check their credit reports, or take other mitigating actions.&#8221; As Sony knew about personal information being accessed for <em>five days</em> before it &#8216;fessed up, I&#8217;m right with him there.</p>
<p>The lawsuit is asking for monetary compensation and free credit card monitoring, and gawd knows where all this will end.</p>

<p>Back in January, Taco Bell and a southern law firm got completely embroiled in a very public drama over the contents of Taco Bell&#8217;s beef taco filling.</p>
<p><a href="http://www.inquisitr.com/96597/taco-bell-beef-is-actually-64-other-things/">The firm alleged that the stuff in Taco Bell&#8217;s tacos</a> was composed of less than 40% stuff other than meat, with the 60+% balance coming from fillers and other non-beef items. Taco Bell fired back that their <a href="http://www.inquisitr.com/96839/taco-bell-ground-beef-update/">meat was actually 88% beef</a>, thank you very much, and vowed to fight the claims casting aspersions on the quality of their Beefy Cheesy Melts.</p>
<p>Earlier this week, the firm Beasley Allen dropped their suit against the Bell. Given the fervor with which Taco Bell contented the claims, however, it should be not very surprising that the chain did not accept the news quietly. Instead, they took out a giant ad <a href="http://blogs.wsj.com/law/2011/04/20/the-lawsuits-in-the-past-but-taco-bell-is-still-on-the-offensive/?mod=google_news_blog">in the </a><em><a href="http://blogs.wsj.com/law/2011/04/20/the-lawsuits-in-the-past-but-taco-bell-is-still-on-the-offensive/?mod=google_news_blog">Wall Street Journal</a>, </em>with a giant header reading, &#8220;Would it kill you to say you&#8217;re sorry?&#8221;</p>
<p>Some text followed, copied below, and the firm has not answered requests from the <em>WSJ </em>to comment on Taco Bell&#8217;s ostensible vindication:</p>
<blockquote><p>The law firm that brought false claims about our product quality and advertising integrity has voluntarily withdrawn their class action suit against Taco Bell&#8230;</p>
<p>Sure, they could have just asked us if our recipe uses real beef. Even easier, they could have gone to our Web site where the ingredients in every one of our products are listed for everyone to see. But that’s not what they chose to do.</p>
<p>. . .As for the lawyers who brought this suit: You got it wrong, and you’re probably feeling pretty bad right about now. But you know what alwasy helps? Saying to everyone, “I’m sorry.”</p>

<p>The U.S. International Trade Commission (ITC) ruled on Friday that Apple did not violate five patents Nokia accused the company of ripping off.</p>
<p><a href="http://www.macrumors.com/c.php?u=http%3A%2F%2Fwww.reuters.com%2Farticle%2F2011%2F03%2F25%2Fapple-nokia-patent-idUSWEN008220110325&amp;t=1301194814"><em> </em></a>According to the complaint, the patents involves electronic devices, mobile phones, computers and portable music players, in other words, most major aspects of Apple&#8217;s core business.</p>
<p>The suit was filed in October 2009 and various countersuits have since been filed, with new suits being added as <a title="Nokia’s CEO memo to the troops leaked" href="http://www.inquisitr.com/97847/nokias-ceo-memo-to-the-troops-leaked/">Nokia</a> believed they had found more infringements in different jurisdictions.</p>
<p>Recently added to the battle is four new suits filed by Nokia against Apple in European courts.</p>
<p>According to <a title="Apple wins suit filed by Nokia" href="http://www.macrumors.com/2011/03/25/judge-rules-in-apples-favor-in-patent-lawsuit-filed-by-nokia/">MacRumors</a>:</p>
<blockquote><p>ITC staff have already issued a preliminary position siding with Nokia regarding Apple&#8217;s countersuit claiming patent  infringement, but an agency judge has yet to issue an official ruling on  that case.</p></blockquote>
<p>More to follow as national and international cases continue to work themselves out in court between these two firms.</p>

<p>Stories of foreign objects found in food tend to spread virally due often to their gross-out nature, or perhaps because the idea of food adulteration is so viscerally unnerving.</p>
<p>There was the guy who claimed to have <a href="http://www.inquisitr.com/30299/man-sues-after-finding-condom-in-his-soup/">found a condom in his French Onion soup</a> a few years back, and the unlucky German tourist who claimed to have bitten down on <a href="http://www.inquisitr.com/29331/unfortunate-german-tourist-finds-tampon-in-his-steak/">a used tampon in his steak</a> at a New York City hotel. Now <a href="http://www.cbsnews.com/8301-504083_162-20043851-504083.html">23-year-old Ashley Philips is suing the Chili&#8217;s chain</a> of restaurants after she says she found a 2-inch long sewing needle in her mashed potatoes.</p>
<p>Philips says that when she summoned the manager, he walked off with the needle and refused to return it to her for testing. But in addition, her lawyer says, there were indications other things were up with the needle in question:</p>
<blockquote><p>&#8220;We have reason to believe that the needle belonged to a member of the cook staff and was used to clean his marijuana pipe,&#8221; attorney Mitch Burns, who is representing Phillips, told the Farmington Daily Times. &#8220;We also have reason to believe that there was ongoing usage of marijuana that was known by all the employees and the management.&#8221;</p></blockquote>
<p>Philips had to stop breastfeeding because of the incident, but has since tested clean for several blood-borne infections. The needle was finally released for testing after nearly two months. Chili&#8217;s has not commented on the allegations.</p>

<p>Once again we learn about a lawsuit from someone connected to the United Football League. This time the Mayo Clinic, in addition to Mark Cuban and a Sacramento PR firm, is suing the league over non payment of 2010 bills. The clinic is claiming the league never paid for player physicals and the like were only partially paid, and that the league owes them around 95 grand. What this seems to indicate is the UFL is out of money, and more money is going to be paid out to the lawyers before this league ever gets back to playing football.</p>
<p>There is now a growing list of persons not paid, or paid very late for their involvement with the UFL in 2010. This is a league that needs a PR win, not more vendors lining up to sue them over non payment. In my mind it is a failure of UFL commish Michael Huyghue, and it seems more and more for this league to be a success a new commish must be found.</p>
<p>More to the point it does not seem that the UFL, as presently organized, can be financially stable. This league is dependent on live attendance for most of its revenue. Unlike the NFL they do not have the luxury of club seat or suite sales to account for well over half of their stadium revenues. That means they have to convince as many people as they can to attend the games. So far that has been an uphill battle, and these continuing issues do not inspire confidence in the fan base.</p>
<p>What this league needs is a national Team Teal campaign that worked so well for the Jacksonville Jaguars last year. They were able to motivate their fan base to get out and support their team.</p>
