Former Hannah Montana co-star Mitchel Musso was arrested in Burbank, CA in October when a routine traffic stop revealed that the Disney Star was intoxicated and now he has struck a plea deal with prosecutors.

The 20-year-old actor has pled no content to one count of driving with a blood alcohol content over .08 and in exchange for that plea he will receive 36 months informal probation and will be ordered to pay a hefty fine and complete alcohol education classes.

In a statement following his plea deal Musso released the following statement:

“I appreciate the court allowing me to resolve my case in the manner it did today. In becoming an adult, I have learned first hand that stepping up and taking responsibility is the best way to move forward.”

He adds:

“I am especially thankful to my family and fans for their unwavering support and encouragement. I am glad to now put this in the past.”

In the meantime Miley Cyrus is partying it up like a rock star, licking penis cakes and partying with her friends. My how the Hannah Montana crew has matured with age.

Do you think Mitchel Musso got off easy or has he really learned his lesson and matured in a few short months?

Running back Knowshon Moreno of the Denver Broncos was pulled over and arrested for drunk driving earlier this month and in a bit of irony his license plate reads “SAUCED” according to the police who pulled the NFL player over.

The official police report says Moreno was driving in his convertible Bentley on Feb. 1 when he was doing 70 in a 45 mile per hour construction zone.

When police approached the football players vehicle they say the smell of alcohol was immediately recognized and he then performed poorly during a field sobriety test which led to his DUI arrest.

Despite taking the advice of his own license plate and being “sauced” the football player was still “very respectful and polite” to the arresting officers.

In a statement the Broncos front office said:

“We take the incident involving Knowshon Moreno very seriously and are thoroughly reviewing this matter. Our organization will continue to gather information and closely monitor this issue while the legal process runs its course.”

No statement has been made by Knowshon Moreno at this time.

Do you think having the license plate “SAUCED” is a bad decision if you plan to drink and then drive your very expensive vehicle around town in the middle of the night?

When Marueen Raymond, 49, was pulled over for reckless driving, she told officers that the problem wasn’t that she had had too many drinks, it was that she had big breasts.

The Huffington Post reports that Raymond was pulled over after driving 50 mph in a 35 mph zone near, swerving over the double yellow line, and parking across two spaces at a Walgreens. When police pulled her over to do a few sobriety tests, Raymond insisted that it was her big boobs that were making her wobble, not the alcohol.

In the complaint, the officer wrote:

“When I told her we were going to do some roadside tasks she told me that I needed to understand that she is big chested and if I asked her to close her eyes and balance she is not going to balance well. She told me ‘Big breast you don’t balance well.’ When I told her she had to keep her hands at her side she stated ‘hell no, not with these.’ Telling me again she can’t do it, not with her big boobies.”

When the officer asked her if she had any injuries, Raymond said that she suffered from whiplash and big boobies. When the officer asked her to walk a straight line, Raymond started to dance. And to top it off, Raymond started to strip to show evidence of her big breasts before officers put her in the back of the squad car.

A PeeWee hockey coach was forced to call 911 on Monday night after his players, their parents and various other spectators noticed that the games zamboni driver was weaving all over the ice and running into boards.

The zamboni was being driven by a Minnesota man with three drunk-driving convictions on his record and according to on-lookers it was taking him 25 minutes to do his job when ice resurfacing typically only takes 10 minutes.

According to the Minneapolis Star Tribune by the time police arrived on the scene the 34-year-old driver had managed to park the zamboni in the ice arenas garage and then failed a sobriety test.

In the official police report officers says the coach noticed before the game that the man’s eyes were red and that he smelled like Red Bull. The coach didn’t realize the man was drunk until a parent after the game said the driver was ”weaving all over, slurring his words.”

The allegedly drunk zamboni driver was taken by police to the local station to have blood-alcohol testing performed at which time charges are likely to be filed against the man.

Being drunk behind any vehicle is a dangerous act, being drunk behind a multi-ton vehicle that’s driving around on ice is just plain stupid, especially when children are present.

That zamboni pictures above isn’t the one in question but wouldn’t that be ironic.

Do you think after three, now possibly four drunk driving violations that the driver of the zamboni needs to be put behind bars and have his license revoked for life?

Taran Noah Smith, best known as “Mark Taylor” on the hit TV show Home Improvement was arrested early Wednesday morning on suspicion of drug possession and driving under the influence (DUI).

The 27-year-old actor was arrested in LA Count at approximately 1:00AM when an officer spotted his 1998 silver Honda Accord parked on an angle in front of a fire hydrant, prompting the officer to investigate the situation.

Smith is said to have been smoking hash, a type of marijuana which the police officer could smell inside the car at the time of the arrest.

After the officer smelled a “strong odor” from inside the vehicle he placed Tran Noah Smith under arrest on a felony charge.

Smith’s reps have not responded to the situation at this time but parking on an angle in front of a fire hydrant at 1:00am while smoking marijuana probably wasn’t the best idea Taran has ever had.

This isn’t the first strange occurrence in the life of the young actor, when divorcing his much older wife she told him that she preferred women over men and as Taran said at the time:

“She began to bring girls home. But if they paid more attention to me than to her, she’d get jealous. Finally, we agreed to have an open marriage. But when I began seeing another girl, Heidi got so mad she broke every dish in the house.?”

His wife then tried to transfer control of their shared company Playfood to her own accounts which led to a court battle over their shared assets.

Perhaps Taran Noah Smith and Dustin Diamond (Screech on Saved by the Bell) should ban together and help straighten out each others lives, they both seem to have a shared trajectory after they left their shows as young actors with no further job in sight.

New Mexico Police received an unusual call on Sunday night when a man hogtied a drunk driver after the drunk was nearly involved in several head-on collisions while traveling the wrong way down a stretch of New Mexico highway known for gruesome and often DUI deaths.

Justin Canuto, 22 was drunkenly driving when he finally pulled off the highway at the Red Mesa Express station on U.S. 550 at which point he was taken from his car and hogtied by a good samaritan who will not face charges.

Canuto pulled into a lot at approximately 9:30pm and after a 911 call was made pedestrians confronted the drunk who then tried to flee on foot. It was at that point that a 26-year-old man tackled Canuto to the ground and hogtied him until police arrived.

When asked if the man would be charged for his hogtie heroics Sheriff Ken Christesen said:

“I think they were trying to save lives and if you look at that intent, I’ll stand behind them everyday.”

At the time of arrest police found an open container in the drunk drivers vehicle.

In the meantime city officials ask that drunks not be confronted and instead citizens call 911 or DrunkBusters in the event of witnessing a drunk driving incident.

Since Jan. 1 six people have already died on the four-lane stretch of rural road. That would be equal to one person each week.

Do you think the unnamed citizen made the right decision in restraining the drunk driver until police arrived on the scene of the crime?

Laura Kaeppeler has been Miss America for close to a week now and she still hasn’t been arrested. Rima Fakih, who won Miss USA in 2010, hasn’t been so lucky. Fakih was arrested on December 3rd for a DUI and today she made an appearance in a Michigan court.

Fakih was pretty much silent through the entire proceedings, opening her mouth only to say “I apologize… My lawyer doesn’t want me to talk.”

Rima said a few more words after her trial on Twitter:

“Sometimes things appear to be going wrong, when in reality they are just being re-arranged for the right outcome!”

Judge Brigette Officer scheduled a March 14th court date, but Fakih’s attorney, W. Otis Culpepper, told reporters today that he believes that Fakih’s case will be resolved with a plea deal.

USA Today reports that Rima Fakih was pulled over on December 3rd after police spotted her weaving swerving down the road at 60 mph. Police found an open bottle of champagne in the car and Fakih’s blood alcohol level was measured at .2, more than twice the legal limit.

Rima Fakih was the first Arab-American woman to win the Miss USA pageant. Here’s a video about her win.

So what’s the difference between Miss USA and Miss America? After Kaepeller won Miss America last week, Rima Fakih tweeted:

“Miss america is the girl next door, miss usa is the girl u WiSH lived next door”

According to USA Today, Rima could face up to 93 days in jails if she is convicted.

Common sense to be something in real short supply these days as one new study out shows that more people are texting while they are driving despite concerted efforts from law enforcement and other organizations to show how dangerous this practice is.

According to new data from the United States National Highway Traffic Safety Administration (NHTSA) the number of people ‘caught’ texting while driving has jumped from 0.6% in 2009 to 0.9% in 2010. This increase has been reflected in the number of accidents related to texting while driving which came in at around the 3,000 mark.

The NHTSA says that they expect to see an increase of 2,300% in the number of accidents due to texting while driving which is why they have led the call for the ban of all texting while driving.

“Using a cell phone while driving is the equivalent of having a blood alcohol concentration level of .08%, the legal limit in most states,” the NHTSA said in a statement. “Using a cell phone can reduce the brain activity associated with driving by 37%.”

via TechnoBuffalo

It should also be noted that in July a Governors Highway Association study found that up to 25% of car crashes in the US is associated with drivers being distracted by some sort of gadget.

Personally I think that anyone caught texting while driving should have their license taken away from them for a number of years equal to the number of words in the last text they sent or read while driving. Texting is the new DUI and can kill just as easily.

Three days ago Federal Aviation Administration (FAA) chief J. Randolph “Randy” Babbitt was arrested under suspicion of driving while intoxicated (DWI) and on Tuesday Babbitt revealed his resignation.

In a written statement Babbitt revealed:

“Today I submitted my resignation to Secretary Ray LaHood and it has been accepted.” Babbitt went on to add, “Serving as FAA Administrator has been an absolute honor and the highlight of my professional career. But I am unwilling to let anything cast a shadow on the outstanding work done . . . by my colleagues.”

In a separate email to FAA employees Babbitt wrote:

“It truly has been the highlight of my professional career.”

Learning about Babbitt’s arrested Transportation Secretary Ray LaHood said of the incident:

“What I told Randy is that I was very disappointed with the way that I learned about this.”

With the agency facing funding uncertainties and tasked with building a $40 billion GPS-based system expected to revolutionize air travel Babbitt’s departure less than half way through his five-year term couldn’t come at a worse time for the agency.

LaHood said after Babbitt’s resignation:

“As FAA Administrator, Randy Babbitt has been a dedicated public servant and outstanding leader,” and ”On behalf of the American people, I thank him for his service and his leadership.”

While Babbitt was said to be cooperative during his arrest, the agencies focus on safe travel overshadowed his quick apology and willingness to take full credit for his mistake.

Do you think it was the right decision for Randy Babbitt to leave his post at the FAA?

Erin Holdsworth led Ohio police down Route 422 at speeds in excess of 120 mph before stumbling out of her car half naked. Holdsworth was arrested wearing nothing but a see thru top, a g-string thong, and a pair of sneakers.

Unsurprisingly, the naked woman driving at 120mph at 4 a.m. in a 2002 Mazda 626 refused to stop at first when she saw police lights behind her. Police had to deploy stop sticks in order to bring Holdsworth’s car to a stop.

Bainbridge Police Chief Jon Bokovitz told The Huffington Post:

“There was a pursuit of about seven miles. An officer from the [Geauga County] Sheriff’s Office was in the area, and he put down stop sticks.”

And that’s when things got weird. Bokovitz said:

“Well, she got out of her car on her own and she had on just a white thong and a fishnet top that was completely see-through. She was obviously under the influence.”

Here’s a video of Erin Holdsworth’s run-in with the Ohio Police Department. (Nudity in the video has been censored.)

Holdsworth refused to take a breathalyzer test and officers said that she was too drunk to take a field sobriety test. But thanks to the cop camera, there should be plenty of evidence to book Holdsworth for a DUI.

As for public nudity, Holdsworth will probably get off the hook.

Bokovitz said:

“In the state of Ohio [public nudity] has to be a willful wanton act, which in this case she wasn’t really walking around or displaying herself to the public.”

Bokovitz has pleaded not guilty to all charges.

Is this your new favorite traffic stop video?

Hannah Montana star Mitchel Musso may have portrayed a squeaky clean image as Oliver Oken on the hit series but in real life the actor has been arrested for driving drunk down the street of Burbank, California.

The 20-year-old underage drinker was pulled over at approximately 3:45 AM at an unrelated traffic accident after police told him to slow down and he failed to heed their warning.

The arresting officer says they approached the actors 2007 Mercedes-Benz and smelled the “strong odor of alcohol” on his breath.

After allegedly failing a field sobriety test and a breathalyzer Musso was arrested and booked into custody at the Burbank Police Station where he was held on $5,000 bail. Musso was released several hours after being booked.

Mitchel Musso current stars in the Disney shows Pair of Kings and PrankStars.

Disney reps are not currently commenting on the actors DUI, then again they have always been good at image control, just look at what they did to keep Hannah Montana going after Miley’s various transgressions.

Do you think Mitchel Musso’s DUI arrest will cause some parents to pull their kids away from his TV show? If anything I believe it gives parents the perfect opportunity to speak with their kids about the dangers of alcohol abuse.

It’s not too often that you hear good news about a bad economy but now a survey has revealed that Americans are drunk driving less often because of a bad financial situation.

According to the survey because many drinkers are out of work or holding on by a thread they are buying less alcohol at bars which in turn has led to less drunk driving cases.

Data compiled by the Centers for Disease Control and Prevention reveals that self-reported drunk driving among adults is down 30% from 161 million cases in 2006 to 112 million cases in 2010.

While the study is not conclusive CDC officials believes that the reason for less cases is the simple fact that even heavy drinkers are purchasing their booze at home rather than heading out to the bars as they had during a robust economy.

According to the CDC poll:

“Possible factors include less discretionary driving as a result of the current economic downturn … and possible changes in drinking location to places where driving is not required such as at home.”

The CDC poll also found that 1.8% of respondents admitted to at least one drunk driving incident in the past 30 days while men account for 81% of 2010′s driving under the influence offenses.

While the study is definitely not conclusive since it uses self-reported cases of driving under the influence the margin of error likely still means a significant drop in the number of people who are driving while drunk.

Do you believe that the bad economy is responsible for the decreasing number of DUI offenses or could it be from better educational practices that information drivers about the risks of getting caught.

If you work for the State Police Liquor Control Enforcement agency it’s probably not a smart move to drink and drive but that’s exactly what a Pittsburgh employee did on Thursday night.

According to Channel 4 news the employee crashed her vehicle just as the Pittsburgh Steelers game was letting out around 11:45pm.

The crash happened in downtown Pittsburgh by 9th and Penn Avenues and the yet to be named city employee was taken into custody after police tested her blood alcohol level and she was found to be over the state’s legal limit.

Adding insult to injury the state liquor control officer was driving her state owned Ford Fusion when the accident occurred. The vehicle is said to have only minor damage, whereas her job status is likely ruined for good.

Do you think the state employee should lose their job given the positions sensitivity to ensuring alcohol is not abused.

Detroit Pistons center Ben Wallace has been arrested and charged with driving under the influence of alcohol (DUI). Police have also charged Wallace with unlawfully carrying a concealed weapon.

Authorities in suburban Detroit say Wallace was arrested after a routine traffic stop revealed alcohol on his breath.

The 37-year-old was pulled over at 3 a.m. ET on Saturday when officers realized that his Cadillac Escalade was driving erratically, upon checking his backpack they found the unloaded pistol.

At this time his blood alcohol content is not known but police say it was over the legal Michigan limit of 0.08 percent.

After being arraigned Wallace was released on a $5,000 personal bond. The basketball star will return to court on Monday.

At this time Wallace’s reps, the NBA and police officials are refusing to comment on the incident. Further details will be provided after his Monday court date.

Just another week, just another professional athlete attempting to skirt the law!

San Francisco 49ers wide receiver Braylon Edwards will pay $50,000 for violating the NFL policy on substances of abuse.

Braylon was arrested and charged with driving under the influence (DUI) in September 2010, during which time he was playing for the New York Jets. In July 2011 Edwards plead guilty to the DUI charge.

At the time of his DUI arrest Edwards was already serving an inactive probation in Cleveland after he was involved in a tussle outside of a nightclub, that fight involved a friend of LeBron James.

According to team officials Edwards will not face a league suspension. Keeping Edwards actively playing is an important part of the 49ers strategy as his one-year contract is meant to give QB Alex Smith a downfield passing threat which San Francisco was lacking before their Edwards acquisition.

Do you think the league should have given Braylon Edwards a more harsh sentence based on his repeat offenses.

Police everywhere are always on the look out for new technology to help them as they combat everything from burglary to murders.

For police in Palm Bay however when it comes to battling drunk drivers they are resorting to a technology that has been around for years: Skype.

“When it comes to impairment, time is of the essence,” Cpl. Morgan said in a statement.

“The goal is get the most accurate capture of evidence closest to the time of the incident and our experience using Skype helps us do that.”

Palm Bay Police Cpl. Darin Morgan worked with Judge David Silverman and prosecutors to develop the system.

Officers use email to forward documents to the judge and then hold a conference call by Skype to obtain warrants for blood draws on suspects. The process can be used for other types of crimes, officials said.

“It’s like a virtual office and courtroom,” Morgan added. “If an officer can stay within his patrol zone instead of having to drive to the courthouse or the judge’s house to obtain the warrant, it saves time and increases the officers ability to protect the public.”

Not many people would disagree with the sentiment that driving a car while under the influence of alcohol is a good idea.

It’s selfish and poses a great risk to other drivers, among a million other reasons why people shouldn’t do it. That said, something about MADD has always gotten on my nerves- perhaps it’s the near thirty minutes I spent detained at a routine alcohol checkpoint Thanksgiving Eve last year, delayed on my late-night journey along with over a dozen other vehicles, all of us interrupted because hey, people drink the night before Thanksgiving. In addition to the dozens of cops and cruisers costing the county God knows what, a big police trailer and several floodlights, each driver was subject to an additional stop at the end of the checkpoint to receive a packet reminding us not to drive drunk and a sticker, courtesy of MADD. State sanctioned proselytizing by private groups seems a bit busybody-ish.

None of these opinions are meant to minimize the fact that drunk driving is a terrible crime, to be sure, and people of all walks of life are arrested for it. Like Debra Oberlin, 48, the former president of a former MADD chapter in Gainesville, Florida. Oberlin didn’t have a change of heart- the chapter ran out of dough back in the 90s and fizzled out. Or maybe she did- it was reported that Oberlin’s BAC was measured at .234 and .239 on Breathalyzer tests, well, well above the legal limit in Florida of .08.

Oberlin, who was a MADD president for four years, told the officer she’d consumed four beers prior to her February 18th arrest. She declined comment on the incident.

When contrasted with this idea, being tagged in an unflattering bridesmaid’s dress isn’t really so bad now, is it?

City councilman Devin Dwyer of Huntington Beach, California, is attempting to push through a proposal wherein people who have been arrested (although not yet convicted) of drunk driving would have their mugshots posted on Facebook everyone to see. The town of 200,000 residents saw 195 people killed in 2009 in alcohol related crashes, and Dwyer commented:

“If it takes shaming people to save lives, I am willing to do it… I’m hoping it prevents others from getting behind the wheel and getting inebriated.”

Ah, yes… the ends justify the means, I think that’s in the Bill of Rights! Of course, lawyers oppose the idea considering the whole lack of a conviction thing- although it should be noted that Dwyer toned down his plan to only include people with more than one DUI arrest. Civil rights professor Clare Pastore explained:

“There’s a little bit of a presumption of innocence problem… It’s not really appropriate to shame someone before they are found guilty.”

Even the cops don’t really like the idea of naming and shaming suspects before a court of law convicts them. Police spokesperson Lt. Russell Reinhart opined:

“We see no value in doing that,” he said. “Law enforcement is not about public shaming.”

This isn’t the first time a jurisdiction has considered using social media to shame people who are accused of a crime, and DUI crimes seem to really bring out the this particular urge in prosecutors. But as we noted back then, innocent people are almost always invariable subject to immeasurably unwarranted personal consequences, such as the diabetic woman who was wrongly “shamed” for a DUI in Nassau County only to be later cleared when it was revealed she had been suffering symptoms related to her diabetes when she was arrested for the crime.

Do you think the benefits of publicly embarrassing people outweigh the possibility of an innocent person suffering consequences from being wrongly named as a drunk driver? Is the use of social media by law enforcement to imply guilt ever appropriate?
