41-year-old Suzanna Corona of Batavia, New York, faces a rare charge for adultery in the state following a daytime tryst at a public playground late last week.

The law under which Corona was charged has only been invoked 13 times since 1972. The the married mother of three was charged along with her lover, 29-year-old Justin Amend, with misdemeanor public lewdness. It’s thought that the adultery charge was tacked on due to the brazenness of the couple’s actions:

“It’s not very often you have people engaging in sexual activity in a park in broad daylight,” Officer Eric Hill told the Democrat and Chronicle in Rochester. “This particular circumstance met all the criteria for the charge.”

Law enforcement officials were called to the park around 5pm Friday, after mothers present with their children reported a couple having sex in full view of parents and children on a picnic table under a pavilion. Amend was spared adultery charges because police say he did not know the woman was married at the time of their arrest. Corona faces up to 90 days in jail or a $500 fine.
