Javi Marroquin Is Taking Legal Action To Ensure He Isn’t Named As The Father Of His Ex-Wife’s Baby


Javi Marroquin isn’t worried about being named as the father of Kailyn Lowry’s third child.

After it was revealed that a law in Delaware resulted in the reality dad being declared as the presumed legal father of his ex-wife’s baby, Javi Marroquin spoke out, revealing he is currently in the midst of having the issue handled by his attorney.

“I’m doing what I have to in case she doesn’t put him on [the birth certificate],” Javi Marroquin said of Chris Lopez. “I’m talking to my attorney right now.”

Javi Marroquin’s ex-wife became pregnant with her third child sometime around the time their divorce was finalized. Months later, she confirmed Lopez was the child’s father.

Although the odd law is certainly something that Javi Marroquin will need to address, he told Radar Online he wasn’t stressed about the ordeal and remained confident that his attorney would get the issue taken care of.

“I’m not worried about it!” he explained.

Javi Marroquin and Kailyn Lowry announced plans for divorce in May of last year and in December, weeks after Lowry was believed to have conceived a child with Lopez, Marroquin confirmed their divorce was finalized.

The former couple tied the knot in 2012 and share one son, 3-year-old Lincoln Marshall Marroquin.

Javi Marroquin was first tied to his former wife’s baby daddy drama last week when a New York attorney revealed that because of his divorce timeline, the legal responsibility to Lowry’s child currently falls on him.

“Delaware law states that the ex-husband is presumed the father of a child if the child is born less than 300 days after the divorce,” attorney Brooke A. Camhi explained to Radar Online.

Camhi went on to explain that in order for Javi Marroquin to be removed from the honor, he would have to file documents, denying the child is his. At the same time, the attorney continued, Chris Lopez, the child’s actual father, will have to file documents confirming the child belongs to him.

In a statement to Radar Online, Kailyn Lowry’s lawyer, David J. Bever, Esq., said, “In Delaware law when a child is born within 300 days of the legal end of a marriage, if no party does anything for two years, the former husband will be considered the father of the child. All the mother of the child has to do is simply request that the Family Court determine paternity of the child pursuant to Chapter 8 if Title 13 of the Delaware Code to appropriately determine who is actually the father.”

The attorney then said that if for some reason Javi Marroquin and Chris Lopez don’t move forward with the required steps, Lowry will have to request a paternity hearing.

“The Court will then order genetic testing to be done and the father, Chris Lopez, will be lawfully determined according to well-established Delaware law,” Bever said.

After his split from wife Lowry last year, Javi Marroquin briefly dated Cassie Bucka and later engaged in a weeks-long romance with former Real World star Madison Channing Walls.

As fans may recall, Javi Marroquin and Madison Channing Walls, who shares a young daughter with her former co-star Tony Raines, went public with their relationship in March after initially meeting on social media and weeks later, after several photos of the two of them were shared, the now-ex-couple went their separate ways.

Javi Marroquin and his family, including his ex-wife and their son, are expected to return to MTV later this year in Teen Mom 2 Season 8.
