Carol Burnett Sued By Dead Co-Producer

Carol Burnett is being sued by a man who co-produced The Carol Burnett Show from 1967 to 1972. The only catch? The man behind the lawsuit, Bob Banner, is dead.

Banner passed away in 2011 from Parkinson’s disease, but that hasn’t stopped his production company from going ahead with the lawsuit against Burnett.

According to the suit, which was filed Wednesday in LA County Superior Court, Banner was cut out of a 2012 deal between Burnett and Time Life for home video distribution.

Banner’s company is asking for a full breakdown of the profits earned from The Carol Burnett Show, including any money made from the home video deal. It’s also demanding its fair share of the revenue.

When TMZ approached representatives for Burnett, there was no comment offered.

The Carol Burnett Show was a variety and sketch comedy show starring Burnett, Harvey Korman, Vicki Lawrence, Lyle Waggoner, and Tim Conway. It originally ran on CBS from September 11, 1967 to March 29, 1978, a run that saw 278 episodes produced.

The series was a favorite of viewers and critics. It clinched 25 primetime Emmy Awards, and in 2007 was listed as one of Time magazine’s “100 Best TV Shows of All Time.”

Burnett, now 79, is no stranger to courts and lawsuits herself. In 2007, Carol Burnett sued 20th Century Fox for copyright infringement, trademark violation, invasion of privacy, and misappropriation of name and likeness over the use of an altered version of her signature closing song and the portrayal of her cleaning lady “charwoman” character in an episode of Family Guy.
