DJ Star’s Breach Of Contract Suit Against Clear Station Dismissed By Judge

New York, NY (CNS) – The three-year breach of contract lawsuit filed by the controversial DJ Star against Clear Channel has been thrown out by a judge.
The disc jockey – real name Troi Torain – was fired by the radio network in 2006 after making lewd on-air comments suggesting he wanted to perform sex acts on his rival DJ Envy’s 4-year-old daughter.
He said, “Yes, I disrespect your seed. If you didn’t hear me, I said, I would like to do an R Kelly on your seed, on your little baby girl. I would like to tinkle on her.”
To emphasize he meant business, he offered a $500 reward for the listener who could give him the location of the child’s school. He also called Envy’s half African American, half Asian wife a “slant-eyed wh***.”
DJ Envy, whose real name is Raashaun Casey, is from Hot 97 radio station, where DJ Star used to work.
Torain received heavy criticisms on his remark, with New York Representative John Liu even calling him a “sick, racist phedophile.” Clear quickly distanced themselves from their employee and suspended him pending an investigation.
Just a few hours later, the station decided to completely terminate their contract with the DJ.
Torain filed a defamation lawsuit against the congressman, which was later dismissed, and a breach of contract suit against Clear. He said that the station hired him to be controversial in the first place, therefore, he was wrongfully terminated.
U.S. District Judge Peter K. Leisure ruled that Clear did not breach his employment agreement when they fired him off the air. His contract apparently gives Clear the right to terminate him if the program content was obscene, indecent, profane or in violation of the law.
Torain was previously charged with endangering the welfare of a child but it was subsequently dropped.
