Jennifer Garner And Ben Affleck Never Intended To Divorce And May Not Be Separated?

Jennifer Garner and Ben Affleck announced their split from one another back on June 30, 2015. However, did the couple ever intend to divorce? Headlines sure pointed toward the former couple fully and legally ending things, yet here they are over a year later and seemingly happy in one another’s company.

The pair has certainly seen their fair share of drama, yet family trips and a living situation that sees both Ben and Jen inhabiting the same property leads to speculation that perhaps the intention was never to fully divorce, yet to take time apart, while continuing to co-parent. Celebrity Dirty Laundry claims that there are new reports suggesting that the pair is still possibly together, in a sense, and not intending to divorce. The publication shares the newly-revealed details.

“[T]here’s a new report that says Ben Affleck and Jennifer Garner’s separation may not be completely true. And that’s because the couple has still been living in the same house, even though Ben Affleck is supposedly living in the guest quarters. According to Jennifer Riemer, an attorney in Los Angeles, California law says that spouses ‘must live in separate residences in order for their earnings and accumulations to be their separate property.'”

Riemer went on to explain that this law recently changed, and before, a couple could remain in the same household, yet following the date of separation could receive earnings separately. The case is different now, leaving Jen and Ben to resort to the guest quarters situation.

Since Garner and Affleck announced their split, it would be expected that Ben would find himself a bachelor pad across the city, seeing as from the sounds of it, the split had a lot to do with the actor’s constant drinking and nights out. However, Ben has proven the world wrong and stayed close to those that he loves, his children and his estranged wife. The pair took part in counselling sessions late last year, and have been seen acting flirtatiously on a number of occasions since the beginning of 2016. The question really is whether we can expect a full reunion between Jen and Ben.

Although Celebrity Dirty Laundry even hints at the separation being fake, it is highly unlikely that this is the case seeing as the two obviously did and do have their issues, and clearly felt at the time it was necessary to distance themselves. Yet, it seems that the distance was perhaps merely to work on mending their marriage, rather than seeing it totally dissolved and ending in divorce.

Bravo noted Riemer’s words on the issue of separation in the early stages of the agreement, even a full year in, and notes how the new laws of having to be fully living in separate dwellings is tricky for parents and families. Usually, neither party is willing lose time with their children.

“Before you could live in the same house and as long as the marriage is over it’s not a problem. The kids and everyone want to be comfortable. The law says being separated means being physically separated, but so many couples continue to live together. They are nervous of losing time with the kids, until custody is established.”

Jen and Ben publicly announced their separation, as aforementioned, on June 30, 2015, after nearly 10 years of marriage. Garner and Affleck share three children together and experienced a tumultuous time following the announcement, when a nanny scandal plagued the family. Garner later verified that a nanny scandal was not any part of the couple’s decision to split, seeing as they had decided to part ways far before any of those rumors began.
