Knoxville, TN – James David Wilson faces up to $1,050 in fines and possible jail time after punching a McDonald’s assistant manager in the face during a dispute over a $1 hot fudge sundae purchase.
The 43-year-old anger management candidate was charged and convicted of misdemeanor assault and disorderly conduct stemming from an incident that occurred in February 2010.
Telling his side of the story, Wilson told the jury:
“The food appeared to be right, but the dessert, it had chocolate on the bottom. The hot fudge should be on top. It freezes up when you get fudge on the bottom of it. I asked them to redo it.”
After Assistant Manager Brad Skelton explained the difference between a hot fudge sundae and the cheaper regular sundae, the men got into a verbal sparing match at which point Skelton refunded the customer’s dollar and asked him to leave the McDonald’s location.
Realizing that the man was in a fit of rage Skelton told the jury that he followed the customer to the door to make sure he left. According to Brad:
“I just wanted to make sure he actually (left). I took two more steps out the door, and he hit me in the face.”
The case eventually moved from misdemeanor court, through a grand jury and all the way to Criminal Court.
Wilson’s attorney Mary Ward tells Knox News that her clients was “charged” and called a racial slur by the McDonald’s assistant manager. Mary Ward argues that her client was only acting in self defense.
The defendant’s attorney was not able to explain why Brad Skelton, who was half the black man’s size, would attack him and shout racial slurs in a McDonald’s that at the time was packed full of black patrons.
Sentencing for the McDonald’s hot fudge sundae attacker is scheduled for September 27.
