Josh Duggar Doesn’t Deny Rough Sex With Porn Star, Argues She Doesn’t Have Enough Proof

Josh Duggar has been dealing with a lot over the past year and is still in rehab, but that isn’t keeping him out of the headlines. Radar Online shared that Josh Duggar has now filed a motion to dismiss the lawsuit that pornstar Danica Dillon filed against him. Josh Duggar is not denying that he had rough sex with her, but he is saying that Danica didn’t provide enough proof against him to say that he assaulted her.

Josh Duggar’s lawyer, Jeffrey A. Conrad, shared details in the court documents that said “the Plaintiff has not alleged that Defendant attempted by force to do injury to her.” The court document then goes on to explain in more detail why Josh Duggar thinks the case should be dismissed.

“Assault requires both intent to place the Plaintiff in imminent apprehension of harmful or offensive contract and the Plaintiff’s actual imminent apprehension. Plaintiff did not provide anything more than a formulaic recitation of the elements of assault and/or battery. Her labels and conclusions are not adequate, particularly because she states that she consented to physical and sexual contact in exchange for payment.”

In these court documents, Josh Duggar never denies that he had two days worth of rough sex with Danica Dillon while his wife Anna was pregnant. At this time, Dillon is trying to get $500,000 from Josh Duggar by saying that he physically assaulted her the first night they were together. Her attorney even said that Dillon “felt as if she were being raped.” This allegedly happened on her first night with Josh Duggar, and for some reason, Dillon went back and met with him again for a second night of sex.

This case will first be heard at a pretrial conference scheduled for January 21 at the U.S. Courthouse in Philadelphia. Radar Online also shared that Josh Duggar is required to file a memo on January 11 and that Danica has until January 9 to file hers. The lead counsel is required to attend this hearing, but it doesn’t sound like Josh Duggar will be there. He is expected to stay in rehab until February.

Starcasm shared that there is a chance that Josh Duggar’s civil charges could end up becoming criminal. When Bill Cosby started being charged in civil suits, his investigation ended up turning criminal, and he was actually arrested last week. Danica is saying that Josh Duggar didn’t pay her and even choked her. These are very serious allegations against the father of four. Anything that Josh Duggar was to say in court could be later used against him. The family might end up just paying Danica Dillon by coming up with a deal that will make both parties happy.

Josh Duggar admitted to using the website Ashley Madison to find women to have sex with and that he cheated on his wife, Anna. Since then, Josh has been in rehab getting help for an addiction to sex. Josh’s family has visited him there, but it doesn’t look like Josh will be coming home right away. He is expected to spend a total of six months there before coming home to Anna and their four children.

Do you feel like Josh Duggar is doing the right thing by trying to get this case dismissed? Sound off in the comments below on your thoughts. Now that Jill & Jessa: Counting On is done airing, viewers are just waiting to see if the Duggars will somehow end up back on television once again. Fans would love to see them return, but most people want it to be without Josh, just like the recent special.
