Durrell Brooks had trouble controlling the waistline of his pants, and for that he’ll be spending a few nights in jail.

Brooks, an Ohio man who accompanied a friend to court, was found in contempt by Lorain Municipal Court Judge Mark Mihok when he turned around and exposed his underwear. Brooks had approached the bench to help present the insurance card for his friend’s car when Mihok noticed the man’s pants sagging and ordered him arrested.

“They’re all adults who come into this court, so they should know how to dress themselves at this point,” Mihok told the Chronicle-Telegram in Elyria, Ohio. “I hope it’s a fad that ends soon.”

Mihok said it’s the third time in the past month he’s had to haul someone off to jail for their sagging pants. He’s known for keeping strict control over his courtroom, admonishing people for ringing cell phones.

But he said his rules for attire aren’t too strict—he’s fine with shorts and even sandals.

“At least you have to have your pants up,” Mihok told the Chronicle-Telegram. “I don’t think I’ve set the bar too high.”

Burrell is not the first person to be arrested for sagging pants, and after the arrest he said he wasn’t happy with the judge’s decision.

“I guess I will have to wear my pants like Urkel,” he told Cleveland’s Fox 8 News. “I mean put them up to my stomach and hope that he don’t say nothing about that.”

Burrell had his sentence reduced to one day.
