Bobbi Kristina Brown Update: Nick Gordon Fights To Stop Civil Lawsuit Amid Possible Criminal Charges
Nick Gordon, Bobbi Kristina Brown’s former boyfriend, is fighting to stop the wrongful death lawsuit against him amid the news that a Georgia grand jury is convening to determine if he’ll face criminal charges.
People reports that Gordon’s attorneys filed a motion on Monday to stop a wrongful death civil suit filed earlier this year by Bobbi Kristina’s conservator, Bedelia Hargrove. The civil suit accuses Gordon of physically abusing Bobbi Kristina, emotionally abusing her, and stealing $11,000 from her bank account while she lay comatose in an Atlanta hospital. Gordon’s attorneys want the civil suit to cease until the criminal investigation is complete.
According to court documents, Gordon’s attorneys feel that the media exposure revolving around the ongoing criminal investigation will portray him as “unfairly, legally and financially prejudiced should he be subject to parallel criminal and civil proceedings.”
Furthermore, Gordon’s lawyers, including high-profile Florida attorney Jose Baez, stated that any claims made in civil proceedings may incriminate Gordon after his deposition, and without all of the evidence, the civil trial would be unfair.
The attorneys referred to Bobbi Kristina’s final autopsy reports to back up their claim, stating that since the Fulton County Medical Examiner didn’t disclose the results, the civil suit is discriminatory as it “would be used to defend and lead to the dismissal of the allegations made against him in this civil proceeding.”
E! Online reports that Gordon still maintains his innocence and denies that he is a “a murderer, a habitual batterer of women, a seducer of young white females, a thief and/or con-man fueled by monetary gain, and a chemist capable of making a toxic cocktail.”
Gordon moved in with Bobbi Kristina and her mother, the late Whitney Houston, when he was 18-years-old. Reportedly, Gordon was present on the day Houston was found unconscious in a bathtub at the Beverly Hilton Hotel in Beverly Hills, California. Shortly after Houston’s death, Gordon began dating Bobbi Kristina in what would become a tumultuous relationship, according to numerous family members and friends.
Bobbi Kristina was found face down and comatose in the master bathroom in her Roswell, Georgia, townhouse on January 31. Gordon reportedly performed CPR on with no results prior to calling for help. A neighbor indicated earlier this year that she heard screaming, banging, and a loud argument coming from Bobbi Kristina’s townhouse the night before she was found unconscious. The neighbor also indicated that Gordon looked “out of it” and continued to huddle in a corner and whisper to friend Max Lomas when the authorities arrived.
Although Gordon has always claimed innocence, he allegedly refused to give Bobbi Kristina’s family a written statement on exactly what happened the night she was found comatose, which resulted in the Bobby Brown, 46, banning Gordon from any hospital visitations. In May, Bobby Brown’s lawyer, Christopher Brown, released a public statement, indicating that Gordon continues to refuse to cooperate.
“Mr. Gordon has every right to remain silent and not share his version of the events with Bobby Brown. We are only concerned with individuals that can help Bobbi Kristina and bring resolution to this investigation. Obviously Mr. Gordon is not as desperate to visit Bobbi Kristina as he wants the world to believe. At least not desperate enough to inform Bobby Brown, in writing, what happened to Bobbi Kristina.”
So far, there is no indication as to whether the court accepted Gordon’s motion to cease the civil trial while the criminal investigation is ongoing. The criminal investigation into the death of Bobbi Kristina Brown, however, remains active and open, according to the Fulton County District Attorney’s Office. Gordon’s representatives have yet to comment on the new motion.
