Model Sues Cosby: 2008 Sex Assault May Put Cosby Behind Bars


A model is suing Cosby with allegations of a 2008 sexual assault in Los Angeles federal court on October 6. According to Fox News, Chloe Goins filed the civil lawsuit Tuesday, claiming Bill Cosby sexually attacked her at the Playboy Mansion sometime in 2008 after spiking a drink causing her to lose consciousness. Fox News reports stated in the lawsuit that “Bill Cosby touched an intimate part of Chloe Goins’ body while she was seriously disabled and/or unconscious.” The model’s lawyer, Spencer Kuvin, believes that the claims made by Goins could be what will incarcerate Cosby.

As reported by Fox News “The Los Angeles District Attorney’s office said last week that it is reviewing a police investigation into Goins’ allegations for a possible criminal case against Mr. Cosby. There is no timetable for when a decision will be made. Goins met with police detectives in January.”

Kuvin stated “The DA now has the file for review from the Los Angeles Police Department” continuing “We are hopeful that they will bring charges against Mr. Cosby.”

Goins is one of as many as 40 women named in the suit who have come forward so far to accuse Cosby of some form of sexual abuse. What makes the model’s claims particularly different than most of the others is her age and when she claims the assault took place. The now 25-year-old Goins’ claim may be the one to tip the scales against Cosby since it supposedly fits within California’s statute of limitations for sex crimes. Reported by Fox News, the model’s lawsuit against Cosby does not detail an exact date of occurrence, but is filed according to the California felony sex crimes bill recently amended.

As stated in “An act to amend Section 801.1 of the Penal Code, relating to crimes “Under existing law, prosecution for specified felony sex offenses, including rape, sodomy, lewd or lascivious acts, oral copulation, continuous sexual abuse of a child, and acts of sexual penetration, that are alleged to have been committed when the victim was under 18 years of age, may be commenced at any time prior to the victim’s 28th birthday” and revised to read “This bill would authorize prosecution of those crimes at any time prior to the victim’s 40th birthday when the crime was committed on or after January 1, 2015, or for which the previous statute of limitations has not run as of January 1, 2015.” The amendment was approved on Sept 30, 2014 by the Governor followed by being filed on Sept 30, 2014 with Secretary of State in California.

If an assault happened before her turning 18 in May 2008, it may prove the model has good reasons to file a lawsuit against Bill Cosby. Cosby could be put behind bars if her allegations are proved to be true in court. The outpouring of claims and lawsuits by women against Cosby have tarnished the once coveted family friendly comedian, causing him to lose jobs as well as honorary degrees and forced resignations of stature from boards such as the Board of Trustees for Temple University.

Following on the heels of Tuesday’s lawsuit, on October 7, AP reporter Anthony McCartney tweeted “Judge refuses to dismiss case against Bill Cosby alleging underage sexual abuse at Playboy Mansion”

Huth’s claim, dating back to approximately 1974, when a then under aged Huth says that Cosby forced her to do a sexual act. The ruling by Los Angeles Superior Court Judge Craig Karlan states that the lawsuit made against Cosby by Huth can proceed.

The Bill Cosby drama has not subsided and has seemingly gained momentum as more women have come forward to claim to be sexually attacked by the celebrity. The lawsuits are mounting as well with Chloe Goins lawsuit being the third since 2014. In addition to suits against the comedian regarding his lewd behavior of forcing women into unwanted sexual acts, three women are also suing Cosby for defamation based on remarks made by him, and those representing Cosby, claiming them to be lying.

The now blemished Cosby has had the support of his wife Camille, family, and friends. Although as more allegations pop up even his closest associates, such as Phylicia Rashad, seem to be furthering themselves from him. Perhaps Bill Cosby’s fate will soon be sealed by a judge in this latest model sues Cosby case.
