Neighbors Having Noisy Sex? Record Them! [NSFW]

One man, pissed at his neighbors having sex annoyingly loudly, decided to record their orgasmic moans and post them online on SoundCloud and leave them a passive-aggressive note with the URL, asking them to keep it down the next time they wish to make love. In a post on the popular news aggregator and community commentary site Reddit entitled My friend was kept up by neighbors last night, which garnered over 2000 comments, it was revealed that a couple, after a lengthy and loud lovemaking session, found a note on their door telling them that the entire world now knew what they sounded like in the throws of their orgasms. Also heard on the recording was a neighbor repeatedly yelling for the couple to shut their gobs.

As one commentator noted, “This is really tapping into SoundCloud’s full potential.” Another noted that the sex recording was “without a doubt, the worst Ke$ha song I’ve heard yet…It’s like she’s not even trying anymore.”

While it is clear that the poster violated SoundCloud’s terms of service, the issue of the legality of the post is less clear.

Mark Rasch, the former head of the Department of Justice’s computer crime unit, told MSNBC that “there is no clear answer.”

“You could possibly make a crime out of it under the federal wiretap law,” he said, “but I’m not aware of any cases where someone is capable of being heard in the public has been prosecuted.”
