Father Who Violently Shakes 3-Month-Old Son And Slams Him To The Floor Charged With Capital Murder


Jose Anthony Juarez, Jr., 26, was charged with capital murder for killing his 3-month-old son, Mason Juarez.

Deputies from San Antonio, Texas responded to a home near Pleasanton Road on Sunday night after receiving a call that a baby was not breathing. The baby was rushed to the Southwest Regional Medical Center and was later brought to a San Antonio hospital, where medical experts said that he had injuries so bad, they didn’t think he would survive.

In an interview, Juarez, the father of the three-year-old boy, proclaimed his innocence. When interviewed a second time, however, the father admitted to violently shaking his son when he wouldn’t stop crying, according to a report by Fox San Antonio.

Atascosa County Sheriff, David Soward, gave the details.

“In his confession to Sheriff’s investigators he admitted to violently shaking the baby two times for about 8 to 10 seconds each, and then tossed the child on the bed, spun the child with his arm, and knocked the baby off the bed onto the floor.”

Baby Mason died on Wednesday evening at the Methodist Children’s Hospital from the severe injuries he sustained and was taken off life support.

Juarez was charged with injury to a child on Sunday night, but on Wednesday evening, upon the death of his son, authorities upgraded his charge to capital murder, KSAT reports.

According to investigators, the 9-1-1 call was from Juarez himself, but they said that he waited for an hour after the violent incident before he called the emergency number. Juarez, however, called the mother of his son, Crystal Hernandez, first. When Juarez told Crystal that their baby wasn’t breathing, she told him to call the authorities, and that’s when he dialed 9-1-1.

Mason’s mother was too devastated to provide a statement regarding the incident. She, however, tasked Pamela Allen from Eagles Flight Advocacy to be the one to represent their family at this difficult time.

“As they were by his bed, they were stroking his face and his head. And, they were remarking on how beautiful he is, because he is a beautiful baby.

“This precious little boy who tragically lost his life. And without going into the who, what, when, and why, we just want to make sure that we support the family and that we give the family an opportunity to give Mason a burial where he’s shown love, respect and support.”

Eagles Flight Advocacy is an outreach organization that is helping the grieving family come up with funds to bury Mason in Devine near family members.

Crystal made the decision to donate Mason’s organs as well “so others will have the opportunity to live,” said Allen.

This isn’t the first time a child has been hurt for being fussy. As the Inquisitr previously reported, a 21-year-old man was arrested after roughing up a 10-week-old baby when he got frustrated with her.
