Defendant has mouth taped shut after court outbursts

A defendant in an Eastern Idaho court room who wouldn’t stay quiet ended up having no choice in the matter, with the help of a roll of duct tape.

6th District Judge Peter D. McDermott has presiding over a hearing for Nicklas Frasure, who was in court for breaching his probation rules that dictated he must take his prescription medication. Frasure wasn’t happy being in court, and made regular verbal outbursts, ignoring several orders from McDermott to restrain himself.

The good judge eventually had enough, and ordered court officials to tape Frasure’s mouth shut with duct tape so the hearing could continue.

Frasure’s lawyer had earlier asked the judge to order a mental competency evaluation for Frasure, arguing that he was “obviously not mentally competent.” Frasure was jailed without the judge ruling on the request to evaluate his mental state.
