Kyle Fox: Charges In Beating Of 2-Year-Old Filed Again After Grisly Injury Photos Hit Facebook


Kyle Fox looked like he was going to get away with what prosecutors say was a grotesque crime — a violent assault on a 2-year-old toddler. Charges against the North Carolina man were dropped on Wednesday, July 8, when witnesses who had said they saw what the 31-year-old man did to the toddler in the bathroom of a fast food restaurant didn’t show up in court.

But after the little girl’s dad posted photos of his daughter’s injuries on his Facebook page, and the disturbing images received more than 60,000 “shares,” not only did the local prosecutors refile the charges against Fox, which had been classified as misdemeanor crimes, but they added a new felony charge as well.

The case against Fox took almost two years to even get to court. The charges stemmed from an incident in October of 2013 when Fox’s wife was looking after the 2-year-old girl, the daughter of Leigh and Craig Hollars.

“I just don’t want anyone else to have to go through this and I know on a daily basis it happens,” Leigh Hollars said. “People told us, ‘Oh, your daughter won’t remember any of this. She’s only 2 years old.’ But she still wakes up screaming and kicking from nightmares.”

The babysitter was a friend and neighbor of the couple, and they saw no reason why she couldn’t be trusted to take care of the toddler for an afternoon. But there was a reason — her husband, Kyle.

Kyle Fox, as it turned out, had a lengthy criminal history. According to public records posted online by the North Carolina Department of Public Safety, the list of Fox’s offenses dates back to 2000 and includes drugs and weapons charges, drunk driving offenses, breaking and entering, assault against a woman, and making threats.

According to the child abuse allegations, when Fox and his wife took the Hollars’ 2-year-old to a Hardee’s restaurant in Walkertown, North Carolina, Fox beat her with a belt when they took the little girl to the bathroom.

Leigh Hollars was, needless to say, shocked when she got a call from the police.

“I get to Baptist Hospital and they tell me that they think that she’s been beaten,” she recalled. “I walk around the corner and my daughter is black and blue. From head to toe.”

But when Leigh and Craig Hollars showed up in court Wednesday — after numerous false starts since the charges were first leveled against Fox in May of last year — they were just as shocked to find that Fox was about to walk free.

“The court system failed. I could have done a better job myself,” said Craig. “And I promise you he’d never have hurt another child again.”

To keep the case alive, they posted the above photos on Facebook and got immediate results. Charges were filed against Fox again the very next day.

“Kyle C. Fox was re-charged today with one count of misdemeanor child abuse,” stated a press release from the district attorney’s office, “as well as the additional charges of felony assault by strangulation and misdemeanor assault on a child under the age of 12.”

The new charges against Fox came the same week a man in Maryland was charged with severely injuring a 6-year-old boy by kicking the child in the head with a steel-toed boot.

Now police are looking for Kyle Fox, who also faces court dates on a number of other, unrelated criminal charges. A warrant is out for the man’s arrest, and police expect to have him in custody soon.
