Boy, 9, Handcuffed And Beaten For Eating Cake, Dies


A 9-year-old boy who ate a piece of birthday cake without permission was handcuffed and beaten. His mother’s boyfriend, 30-year-old Robert Wilson, was charged Wednesday with first- and second-degree assault, reckless endangerment, and child abuse.

Hagerstown, Maryland, police Captain Paul Kifer stated that the boy, Jack Kirby Garcia, died Sunday at Children’s National Medical Center in Washington. Police will confer with Washington County prosecutors regarding whether additional charges will be brought in the case, according to ABC Channel 7.

Garcia’s mother’s brother told police that the boy was handcuffed on Tuesday as punishment for stealing birthday cake. He indicated that Wilson hit the boy in the stomach after the handcuffs were removed. The boy’s birthday was three days earlier, and it’s not clear whether the birthday cake he had eaten was for his birthday on June 27, according to 48 Crimesider.

According to the Hagerstown Police Department, the alleged incident occurred at an apartment on Lynnehaven Drive in Hagerstown, Maryland. When the police went to the apartment on Tuesday night, Garcia had bruises, contusions, and abrasions all over his body. According to Hagerstown police, the boy had been wounded on his neck, face, back, buttocks, abdomen, and legs. He was also unconscious and not breathing.

Detectives also learned that Garcia’s mother and Wilson had denied him medical attention for approximately four hours despite the fact that another adult male, who was at the residence at the time of the assault, had called 911 for assistance. The boy’s mother met the CRS outside the residence when they arrived. She allegedly told paramedics that they were not needed and that her son was simply “congested,” according to the Daily Mail. Detectives indicated that the CRS was called back to the residence at 10:37 p.m. after the boy stopped breathing.

Robert Wilson was being held on $1 million bail before further charges potentially being filed now that Jack Garcia died.
