HIV-Positive Teacher Purposely Exposes 16-Year-Old Male Student To Virus, Police Say

A 37-year-old HIV-positive Louisiana teacher is behind bars after he allegedly exposed a 16-year-old male student to the virus during sex, according to police.

The Terrebonne Parish Sheriff’s Office learned last month of the illegal encounter and arrested the HIV-positive teacher, who had only worked at the H.L. Bourgeois High School for one year prior to the incident.

The HIV-positive teacher — who denied the charges — was also a track coach for the High School’s Freshmen team and was arrested on Wednesday on school grounds.

According to a report in WWL-TV, prior to the HIV-positive teacher’s arrest, police had questioned him about the alleged sexual encounter, but they later released him.

“We can establish the fact that there was an encounter that happened,” Terrebonne Parish Sheriff’s Chief of Detectives Malcolm Wolfe told the station, and added, “We continued our investigation where we established more evidence that something did happen, and at that point we got a warrant for his arrest.”

Police didn’t say when or where the alleged encounter took place, but the Sheriff’s office says that the resource officer at the school was the first to receive alerts that the HIV-positive teacher was in an illegal relationship with the 16-year-old.

Investigators believe that it was during the last year that Nesby began the inappropriate encounters with the boy, and detectives believe he intentionally exposed the teen — without his knowledge — to the HIV virus, which causes AIDS.

Originally, the HIV-positive teacher was charged with carnal knowledge of a juvenile, but when it became apparent that he was infected with AIDS, he was additionally charged with intentional exposure of the virus.

According to Eyewitness News’ legal analyst, both charges come with a lengthy stay in prison:

“Both of these charges are felonies. Both of these charges carry with them the maximum sentence of 10 years in prison,” Foret said. “They’re both very serious felonies.”

On Friday morning, the Sheriff’s office officially charged the HIV-positive teacher with intentionally exposing the teen to the virus and his bond was doubled to $1,000,000.
